房屋流转中居住权人利益的法律保护

【摘要】:和谐社会促进我国经济稳健发展,随着生活水平的逐步提高,人们对住房条件也愈加重视。或许出于中国传统购房置地的观念,或许因为购房款占据了生活支出的最大比例,中国人对房屋的关注程度更为突出。我国现行法律针对房屋买卖中交易双方之间的权利义务关系,作了细致而全面的规定。但是,这些法律规定却忽视了一个群体。这个群体与房屋之间存在着密不可分地联系,但却又无法直接参与房屋流转交易的过程,而房屋的流转又与他们的生存居住息息相关。目前的法律规定对他们视而不见,即没有规定他们享有的交易房屋的权利,亦没有规定他们应履行的义务。这个处于法律真空地带的群体即是居住权人。 居住权人享有居住权。居住权是源于罗马法的古老的制度。居住权制度曾具有重要的法律地位,它与使用权及用益权一起构成了罗马法人役权制度的框架体系。一直到现代,许多大陆法系国家和地区都流传沿袭了居住权制度。但是,在我国法律中尚未明确规定居住权这一法律制度,亦没有居住权人的概念,导致居住权人利益缺乏法律保护的解决途径。 本文主要以司法实践中的真实案例为研究对象,针对不同房屋流转方式中涉及居住权人利益保护的问题,整理提炼出亟待解决的疑难问题。一、房屋买卖对居住权人利益的影响;二、房屋改革对居住权人利益的影响;三、房屋动迁对居住权人利益的影响;四、房屋所有权人与居住权人对房屋使用的分歧。通过分析研究提出三条解决途径,第一,建立居住权人制度体系,制订单行法等,对居住权人在房屋流转中的利益予以保护,从法律制度上保护居住权人在房屋流转中的权益;第二,允许房屋所有权人与居住权人议定居住权,允许当事人自由平衡所有权与居住权;第三,建立居住权行政登记、公示与查询制度,居住权公开有利于保护居住权人权益,同时,也保护房屋流转当事人的权利,减少纠纷的发生。 对房屋流转中居住权人利益法律保护,能够更好地加强社会的和谐稳定,增强房屋流转的经济效率,保护房屋流转交易的稳定性,增加居住权人对他人所有房屋的利用效率。
[Abstract]:Harmonious society promotes the steady development of economy in our country. With the improvement of living standard, people pay more attention to housing conditions. Perhaps because of the traditional Chinese concept of buying land, perhaps because home purchases account for the largest proportion of living expenses, Chinese people pay more attention to housing. The current law of our country makes a detailed and comprehensive regulation on the relationship of rights and obligations between the two parties in the sale and purchase of houses. But these laws ignore a group. There is a close relationship between this group and housing, but they can not directly participate in the process of housing circulation transactions, and the circulation of housing is closely related to their living and living. The current law ignores them, neither their right to trade houses nor their obligations. The group in the legal vacuum is the right of abode. The person who has the right of abode shall have the right of abode. The right of abode is an ancient system derived from Roman law. The system of right of residence once had important legal status, which, together with right of use and right of use, constituted the frame system of the system of servitude of legal person in Rome. Up to modern times, many civil law countries and regions have inherited the right of abode system. However, the legal system of residence right has not been clearly stipulated in our country's law, and there is no concept of resident right person, which leads to the lack of legal protection for the interests of resident right person. This article mainly takes the real case in the judicial practice as the research object, in view of the different housing circulation way involves the residence right person's benefit protection question, refines the difficult question which urgently needs to be solved. First, the impact of housing sales on the interests of residents; second, the impact of housing reform on the interests of residents; third, the impact of house relocation on the interests of residents; fourthly, the differences between the owners of houses and the occupants on the use of houses. Through the analysis and research, three solutions are put forward: first, to establish the system of residence right holders, to formulate separate laws and so on, to protect the rights and interests of residents in the housing circulation, and to protect the rights and interests of the right holders in the housing circulation from the legal system; Second, allow the owner of the house and the right of residence to agree on the right of residence, and allow the parties to freely balance the right of ownership with the right of residence; third, establish the administrative registration of the right of residence, public announcement and inquiry system, the disclosure of the right of residence is conducive to the protection of the rights and interests of the person in residence. At the same time, also protect the rights of housing transfer parties, reduce the occurrence of disputes. The legal protection of the rights of residence in the housing circulation can strengthen the social harmony and stability, enhance the economic efficiency of the housing circulation, protect the stability of the housing circulation transactions, and increase the use efficiency of the residence rights person to the houses owned by others.
