司法审判中的利益衡量

【摘要】：利益衡量做为一种司法衡平的方法，它的运用可以探究到19世纪末20世纪初美国实用主义法学家和法官们的司法实践。所谓利益衡量，就是指当法官在司法审判中，面对相互冲突的利益，，无法运用法律、法规做出决定时，便运用经济分析、价值判断等方法，对利益进行取舍的过程。在当今世界各地的司法实践中，利益衡量的运用变成了一种普遍的趋势。 我国经过改革开放的深入发展，利益关系和利益格局也发生了深刻的变化，对利益分配的调整、利益冲突的协调、利益关系的平衡提出了更高的要求。本文运用归纳、比较和案例分析的方法，从理论和实践两方面来研究利益衡量理论及其在司法审判中的运用，以便更好的弥补法律漏洞，实现司法公正，促进社会和谐。 本文共分为四个部分，着重探讨利益衡量的适用原则以及利益衡量方法在司法审判中的适用。 第一部分：介绍了利益衡量理论的研究现状，阐述该理论的涵义，揭示了利益衡量运用的方法主要是经济分析方法、价值判断方法，为深入研究利益衡量的适用原则做必要的理论前提准备。 第二部分：阐述利益衡量的适用原则，这些原则包括利益位阶原则、利益最大化原则、维护弱者利益原则、利益克制原则、法律效果和社会效果相一致原则。对利益衡量适用原则的透彻分析，有助于利益衡量方法在司法审判中得到充分的运用。 第三部分：分析了利益衡量在司法审判中运用的意义，揭示了利益衡量在司法审判中要参考公共政策和社会主流价值观念，并要遵循调查分析、权衡取舍、论证修正的运用程序。 第四部分：探寻了利益衡量在司法审判运用中的缺陷，这些缺陷主要体现在对利益衡量的忽视和滥用上，因此，提出了三种完善措施：提高法官素质、建立利益衡量的参照标准、公开利益衡量过程和结果。
[Abstract]:As a method of judicial equity, the use of interest can be used to explore the judicial practice of American pragmatists and judges at the end of the nineteenth Century and early twentieth Century. The so-called interest measurement refers to the use of economic analysis when judges are confronted with conflicting interests in judicial trials and cannot use laws and regulations to make decisions. In the judicial practice of today's world, the application of interest measurement has become a general trend.
After the deepening of reform and opening up in China, profound changes have taken place in interest relations and interests pattern, and higher requirements have been put forward for the adjustment of interest distribution, the coordination of interests conflict and the balance of interest relations. This paper studies the theory of interest measurement and its theory and practice from two aspects of theory and practice by using the methods of induction, comparison and case analysis. In judicial trial, we can make up for loopholes in law, achieve judicial justice and promote social harmony.
This article is divided into four parts, focusing on the application principle of interest measurement and the application of interest measurement in judicial trials.
The first part introduces the research status of the theory of interest measurement, expounds the meaning of the theory, and reveals that the methods of the use of the interest measurement are mainly the economic analysis method, the method of value judgment, and the necessary theoretical precondition for the in-depth study of the applicable principles of interest measurement.
The second part: expounds the applicable principles of interest measurement. These principles include the principle of interest level, the principle of maximization of interests, the principle of safeguarding the interests of the weak, the principle of benefit restraint, the principle of the agreement between the legal effect and the social effect. A thorough analysis of the principle of the application of the interest measure is helpful to the full of the method of interest measurement in the judicial trial. Application.
The third part: analysis the significance of the use of the interest measurement in the judicial trial, and reveals that the interest measurement should refer to the public policy and the social mainstream values in the judicial trial, and should follow the investigation and analysis, balance the trade-offs, and demonstrate the revised application procedure.
The fourth part: exploring the defects of the interest measurement in the application of judicial trial. These defects are mainly reflected in the neglect and abuse of the measure of interest. Therefore, three kinds of measures are put forward: to improve the quality of the judges, to establish the reference standard for the measure of interest, and to measure the course and results of the public interest.
