论清末民初县域司法理念的变迁——以《塔景亭案牍》为依据

【摘要】：清末民初之际是中国历史上由帝制转向民主制的社会转型期,伴随时代急剧变化,自上而下在全国范围内大规模发动并践行以移植西法为取向的法律近代化之路。而当时的江苏句容县域浓厚的父母官司法意识、以和睦家族为首先司法目标等传统司法理念依然根深蒂固,法律新风带来的某些司法理念的变迁则是浅表性的。法律近代化的实现程度离不开对民间传统因素的认识和改造。
[Abstract]:At the end of the Qing Dynasty and the beginning of the Republic of China, it was a period of social transition from monarchy to democracy in the history of China. With the rapid changes of the times, the law modernization road of transplanting western law was launched and practiced in a large scale from top to bottom in the whole country. At that time, the strong judicial consciousness of parents and officials in Jurong County, Jiangsu Province, and the traditional judicial ideas, such as the harmonious family as the first judicial goal, are still deeply rooted, and the changes of some judicial ideas brought by the new trend of law are superficial. The realization of the modernization of law is inseparable from the understanding and transformation of folk traditional factors.
