复合型社区矫正制度研究

【摘要】：社区矫正作为一种国际上日益流行的社会化行刑方式,正在我国得到探索和实践。社区矫正制度的推行正是公共管理主体多元化的具体体现,国家相关政策明确规定了社区矫正的执行是由专门国家机关在相关社会团体和民间组织以及社会志愿者的协助下共同完成的,这意味着社区矫正制度的执行主体是由政府组织、非政府组织、社会团体和社会志愿者成等多个部分共同构成,其对执行主体的规定正是公共管理主体多元化的发展趋势的具体体现。本文试图从现代公共治理理论的视角,把社区矫正视为一种多元主体参与公共物品供给的过程。本文的核心观点是,建立一种复合型的社区矫正制度,强调在发挥政府组织作用的同时,提倡大力发展社会团体和民间组织,广泛吸纳社会力量和资源,完善社区矫正管理的体制机制,建立健全社区矫正治理模式。因此,本文首先在对复合型社区矫正制度的概念,特征及理论基础进行阐释的基础上,分析了现有社区矫正制度的不足之处,及建立和完善复合型社区矫正制度的必要性,最后结合我国实际,论述了复合型社区矫正制度的框架设计以及建构途径。
[Abstract]:Community correction is being explored and practiced in our country as an increasingly popular socialized execution method in the world. The implementation of the community correction system is the concrete embodiment of the diversification of the main body of public administration. The relevant national policies clearly stipulate that the execution of community correction is carried out jointly by the special state organs with the assistance of relevant social organizations, civil organizations and social volunteers, which means that the main body of the implementation of the community correction system is organized by the government. Non-governmental organizations, social organizations and social volunteers are made up of several parts together. The provisions of the executive body are the concrete embodiment of the development trend of the diversification of the public management subject. This paper attempts to analyze the situation from the perspective of the modern theory of public governance. Community correction is regarded as a process in which multiple subjects participate in the supply of public goods. The core point of this paper is to establish a compound community correction system, emphasizing that while giving full play to the role of government organizations, we should promote the development of social organizations and non-governmental organizations, and absorb social forces and resources extensively. Improve the system and mechanism of community correction management, establish and perfect community correction governance model. Therefore, on the basis of explaining the concept, characteristics and theoretical basis of the compound community correction system, this paper analyzes the shortcomings of the existing community correction system and the necessity of establishing and perfecting the compound community correction system. Finally, combined with the reality of our country, this paper discusses the frame design and construction way of compound community correction system.
