【摘要】：衡量某个国家法治化程度水平高低的重要指标之一是要看这个国家的律师制度是否健全。新中国成立后我国律师制度的发展历程可谓跌宕起伏,处于在徘徊中前进的过程,但是我国律师制度从改革开放以后才算得上真正意义的发展。而作为律师制度重要组成部分的律师管理制度无论是从理论上还是到实践上尚有很多不足之处,特别是与英、美、德、日等发达国家相比,差距甚大,亟需改变现状。本文从研究我国律师管理制度的角度出发,并在借鉴国外相关律师管理制度方面的制度的基础上进一步提出对我国律师制度的完善建议,共分为四个部分：第一部分主要论述了我国律师管理制度的基本理论,从律师管理制度的概念、历史发展和必要性等方面进行了理论阐述。第二部分论述了国外律师管理制度。着重介绍了世界上比较具有代表性的四个国家：英国、美国、德国、日本的律师管理制度的基本情况,比较了几个国家之间在律师管理制度方面的相同和相通之处,从中总结可借鉴之处,并在比较分析的基础上提出了对我国律师管理制度建设方面的一些启示。第三部分侧重于论述我国律师管理制度的发展现状、问题和原因分析。先针对我国律师管理制度发展现状中关于法律规范、管理模式、具体内容作了较为详尽的阐述,之后指出了我国律师管理现状中存在的问题,并针对问题分析了其存在的原因。第四部分重点论述了我国律师管理制度的完善。针对我国律师管理制度中存在的问题提出了完善的建议。这部分以律师管理规范化建设的完善、司法行政机关行政管理的完善、律师行业自治的完善及司法行政机关与律师协会之间的完善四大方面试图论证出：实行律师协会的行业管理势在必行,律师管理制度亟待进行改革创新。
[Abstract]:One of the important measures of a country's rule of law is to see whether the country's lawyer system is sound. After the founding of New China, the development of China's lawyer system can be described as ups and downs, in the process of wandering forward, but our lawyer system from the reform and opening up to the real significance of the development. As an important part of the lawyer system, the lawyer management system has many shortcomings in theory and practice, especially compared with the developed countries such as Britain, America, Germany, Japan and so on, so it is urgent to change the present situation. From the angle of studying the lawyer management system of our country, this paper puts forward some suggestions to perfect the lawyer system of our country on the basis of drawing lessons from the related foreign lawyer management system. It is divided into four parts: the first part mainly discusses the basic theory of the lawyer management system in our country, expounds the concept, historical development and necessity of the lawyer management system, and discusses the foreign lawyer management system in the second part. This paper emphatically introduces the basic situation of the lawyer management system of four representative countries in the world: Britain, the United States, Germany and Japan, and compares the similarities and similarities in the lawyer management system among several countries. Based on the comparative analysis, the author puts forward some enlightenment to the construction of the lawyer management system in China. The third part focuses on the analysis of the current situation, problems and reasons of the development of the lawyer management system in China. First of all, in view of the current situation of the development of the lawyer management system in China, the author makes a detailed exposition on the legal norms, the management mode and the specific contents, and then points out the problems existing in the present situation of the lawyer management in our country. The fourth part focuses on the perfection of our lawyer management system. In view of the problems existing in China's lawyer management system, some suggestions are put forward. This part is based on the perfection of the standardized construction of lawyer management, the perfection of the administration of judicial administration, The perfection of the autonomy of the lawyer profession and the perfection between the judicial administrative organ and the bar association try to prove that it is imperative to carry out the profession management of the lawyer association, and the lawyer management system needs to be reformed and innovated urgently.
