以公正司法提升司法公信力

【摘要】：正十八届四中全会是中国共产党第一次召开全会专题研究依法治国,并第一次就此专门作出决定,这是以习近平同志为总书记的党中央作出的历史性贡献,具有里程碑意义。全会通过的《关于全面推进依法治国若干重大问题的决定》(以下简称《决定》)对新时期的司法工作指明了方向,作出了部署,提出了新的要求。如何全面理解和切实落实这些部署要求,是非常重要也非常紧迫的一项任务。笔者拟从辨证法治观视角对此作一粗浅解读。所谓辩证法治观,其精义是以普遍联系和对立统一转化的观点和思维方式理解和推行法治。首先,辩证思维对于法治至关重要。法治既是一门追求确定性的科学,又是一门充满辩证法的艺术。所谓辩证,意指以普遍联
[Abstract]:The fourth Plenary session of the 18th CPC Central Committee is the first time the Communist Party of China has convened a special session to study governing the country according to law, and has made a special decision on this issue for the first time. This is a historic contribution made by the CPC Central Committee with Comrade Xi Jinping as its general secretary and has a landmark significance. The "decision on comprehensively promoting governing the country according to Law" adopted by the Plenary session (hereinafter referred to as "the decision") pointed out the direction of the judicial work in the new period, made arrangements and put forward new requirements. How to fully understand and implement these deployment requirements is a very important and urgent task. The author intends to make a brief interpretation from the viewpoint of dialectical rule of law. The essence of the so-called dialectical view of governance is to understand and implement the rule of law in the view of universal connection and unity of opposites. First, dialectical thinking is crucial to the rule of law. The rule of law is not only a science seeking certainty, but also an art full of dialectics. The so-called dialectics means universal union.
