我国检察委员会制度研究

【摘要】:检察委员会制度是我国检察制度的一项创举,是中国特色社会主义检察制度的重要内容。检察委员会制度起源于1941年,它的发展经历了重大的变化,从最初由检察长担任委员会议主席,再到后来检察长领导检察委员会,进一步发展到目前这检察长主持检察委员会,已经成为极具中国特色的检察机关决策机制。 在中央深化司法体制改革的要求下,,检察委员会制度规范化建设不断加强,统一规范的检察委员会制度已经基本形成。伴随制度的不断完善,一些困扰检察委员会工作的问题得到解决,但实践中又涌现出新的问题,检察委员会制度的理论需要继续深化拓展。 本文由六个部分组成。第一部分由历史入手,介绍检察委员会制度形成发展的历史,并着重叙述检察委员会现有规范化制度体系演进变化发展的历程。第二部分从检察委员会是检察机关的最高业务决策机构,是民主集中制原则的于检察权运行中的具体体现,有利于规范检察权的健康运行,能够加强内部监督保障司法公正的角度,论述检察委员会制度的价值基础。第三部分关于检察委员会的基本组织结构,论述检察委员会人员组成,委员任职资格、任期、员额、办事机构情况,这些构成检察委员会制度的基本框架。第四部分实证分析在现有的检察委员会制度和规范体系下,从议题提请,到会议审议和作出决定,再到决定的执行,探讨了检察委员会议事决策的运行过程。第五部分在前述分析的基础上,探讨了目前检察委员会制度仍然存在的问题,诸如议题范围不明确,议事效率不高,议而不决,对检察长制约不足,检察委员会委员自身能力建设不足,专职委员和检察委员会办事机构定位不明确等。第六部分,在检察委员会制度和规范体系方面,提出进一步完善的举措。全国四级检察机关,具体的业务工作存在很大区别,不宜设定统一的指标考察检察委员会的实效。就如何明晰检察委员会审议的议题范围,提出一些个人的思考。此外,对已有的具体规范应该进一步细化,对议事程序也可以进一步改革,在程序上需要制约检察长的权力,要加强委员自身能力建设,还应当规范检察委员会办事机构设置发挥其职能作用。
[Abstract]:The procuratorial committee system is an innovation of the procuratorial system of our country and an important content of the socialist procuratorial system with Chinese characteristics. The procuratorial committee system originated in 1941, and its development has undergone major changes. From the chief procurator as the chairman of the committee at first, to the procuratorial committee leading the procuratorial committee by the chief procurator later, to the procuratorial director presiding over the procuratorial committee at present, It has become a decision-making mechanism of procuratorial organs with Chinese characteristics. Under the request of the central government to deepen the reform of the judicial system, the standardization of the procuratorial committee system has been strengthened, and the unified and standardized procuratorial committee system has been basically formed. With the continuous improvement of the system, some problems puzzling the work of the procuratorial committee have been solved, but new problems have emerged in practice. The theory of the procuratorial committee system needs to continue to deepen and expand. This paper consists of six parts. The first part begins with history, introduces the history of the formation and development of procuratorial committee system, and emphatically narrates the course of evolution and development of the existing standardized system of procuratorial committee. The second part is that the procuratorial committee is the highest professional decision-making organ of the procuratorial organ and the concrete embodiment of the principle of democratic centralism in the operation of procuratorial power, which is conducive to standardizing the healthy operation of procuratorial power. This paper discusses the value basis of procuratorial committee system from the angle of strengthening internal supervision and safeguarding judicial justice. The third part deals with the basic organizational structure of the procuratorial committee, including the composition of the procuratorial committee, the qualifications of the procuratorial committee, the term of office, the posts, and the office of the procuratorial committee, which constitute the basic framework of the procuratorial committee system. The fourth part of the empirical analysis under the existing procuratorial committee system and normative system, from the subject to request, to the meeting review and decision, and then to the implementation of the decision, discussed the procuratorial committee of the operational process of decision-making. The fifth part, on the basis of the foregoing analysis, discusses the problems that still exist in the procuratorial committee system, such as the unclear scope of the topic, the inefficiency of the proceedings, the lack of discussion without decision, and the lack of restriction on the procuratorial director. The procuratorial committee member's own ability construction is insufficient, the full-time committee member and procuratorial committee's office position is not clear and so on. The sixth part, in the procuratorial committee system and the standard system, proposed the further consummation measure. The national four-level procuratorial organs have great differences in their specific work, so it is not appropriate to set a unified index to examine the effectiveness of the procuratorial committee. On how to clarify the scope of the issues considered by the procuratorial committee, put forward some personal thinking. In addition, the existing specific norms should be further refined, the procedure of the proceedings may also be further reformed, the powers of the Procurator General should be restricted in the procedure, and the capacity-building of the members themselves should be strengthened. We should also standardize the establishment of procuratorial committee offices and give play to their functions.
