诉讼制度改革下检察案件管理的职能定位、现状与发展

【摘要】：新的案件管理制度是以2011年最高检建立案件管理办公室为标志,到2014年底全国各级检察机关普遍设立案件管理部门,展开管理、监督、服务、参谋四项职能,开启的检察案件管理新模式、新理念、新制度。因为是一项新工作,定位如何、现状是否符合预期、怎样才能更好的开展工作是本文想要研究的。从对职能定位的内容开始进行把握,笔者总结出现阶段实务中存在"侧重流程管理,推崇程序正义"、"兼顾程序与实体"两种以管理监督为核心的工作模式,及以"监督、服务"为定位的服务监管模式。并将案管各种工作模式存在的履职不全、监督不刚、工作被动、案多人少等共性问题予以提出。通过介绍笔者所在临河区检察院案管工作的具体做法和成效,从实践经验总结中提炼出了案管发展应遵循:程序与实体监督并行、管理与服务并重、监督与保障统一、持续创新四个原则。最后,结合实践工作提出案件管理工作要以精细化发展为方向的稚嫩建议,希望可以为解决案管工作现存共性问题及检察案件管理实践工作的更好开展提供思路。
[Abstract]:The new case management system is marked by the establishment of the case management office at the highest level in 2011. By the end of 2014, the procuratorial organs at all levels in the country generally set up the case management department and launched the management, supervision, service and the four functions of the staff. The new mode of procuratorial case management, the new idea and the new system are opened, because it is a new job, the position and the present situation Whether it is in conformity with the expectation and how to carry out the work better is the study of this article. From the beginning of the content of the function orientation, the author summarizes the two kinds of work mode, "focusing on process management, promoting procedural justice", "taking into account the procedure and entity", and taking "supervision, service" as the core of the work. It also puts forward the common problems that are not complete, the supervision is not rigid, the work is passive, and the cases are few. Through the introduction of the concrete practice and effectiveness of the case management of the procuratorate in Linhe District, the development of the case management should be followed from the summary of the practical experience: the procedure and the entity supervision. In parallel, the management and service are equal, supervision and guarantee are unified, and the four principles of continuous innovation are continued. Finally, combining the practice work, this paper puts forward the tender suggestions that the case management should take the fine development as the direction, and hopes to provide the ideas for solving the common problems existing in the case management and the better development of the practice of procuratorial case management.
