庭前调解中的思想政治工作研究

【摘要】：我国的调解制度由来已久，曾被西方国家誉为“东方经验”。调解也由于其经济、便捷及对和谐社会建设有利的一面深受人们的喜爱。本文主要研究庭前调解中思想政治工作的作用及其缺乏原因的分析，进而提出解决的办法。论文以研究庭前调解中的思想政治工作为主线，从理论深度剖析了庭前调解解决纠纷对构建和谐社会的价值。本论文从当下庭前调解中思想政治工作欠缺的现实为逻辑起点，着重分析了欠缺的实际表现及欠缺造成当事人之间矛盾的加深，，不利于法制建设，导致执行难，最终造成社会的不稳定。研究了运用思想政治工作促进庭前调解顺利进行的路径原则与设计。为了缓解司法资源的不足及更有利于纠纷的解决，指出参与庭前调解中思想政治工作的主体应为多元主体，排除了一元主体——法官调解的局限性，同时指出了庭前调解中思想政治工作应坚持以人为本的原则，把当事人的利益放在首位，真正体现民法中的意思自治原则。除此之外，对情理法相结合的原则在庭前调解中的作用做了进一步的研究，指出情理法相结合是社会主义法治的基本要求，只有情理法的充分融合，才能使纠纷实现刚性法律下的柔性处理，进而实现法律效果和社会效果的有机统一。立足当代中国的国情和法治发展的进程，阐述了庭前调解中发挥思想政治工作必须从机制上保障和参与调解的人员的思想政治工作意识和思想文化素质的提高，只有各方面的共同作用使然，庭前调解中的思想政治工作才能有序开展，纠纷才能及时有效地得到解决，社会才能更趋和谐。
[Abstract]:China's mediation system has a long history and has been praised as "Eastern experience" by western countries. Mediation is also popular because of its economy, convenience and beneficial to the construction of a harmonious society. This paper mainly studies the function of ideological and political work in the mediation before trial and the reasons for its lack, and then puts forward some solutions. Based on the study of ideological and political work in pretrial mediation, this paper analyzes the value of pre-court mediation in building a harmonious society from the theoretical depth. Starting from the reality of the lack of ideological and political work in pretrial mediation, this paper focuses on the analysis of the actual performance of the deficiency and the deepening of contradictions between the parties, which is not conducive to the construction of the legal system and leads to difficulties in implementation. Ultimately, social instability is caused. This paper studies the path principle and design of using ideological and political work to promote the smooth conduct of pre-court mediation. In order to alleviate the shortage of judicial resources and help to resolve disputes, it is pointed out that the subject of ideological and political work should be pluralistic subject, and the limitation of monistic subject-judge mediation is excluded. At the same time, the author points out that the ideological and political work in pretrial mediation should adhere to the principle of people-oriented, put the interests of the parties in the first place, and truly embody the principle of autonomy of will in the civil law. In addition, the author makes a further study on the role of the principle of the combination of reason, reason and law in the mediation before the trial, and points out that the combination of the law of reason and reason is the basic requirement of the socialist rule of law, and only the full integration of the law of reason, Only then can the dispute be handled flexibly under rigid law, and then the organic unification of legal effect and social effect can be realized. Based on the national conditions of contemporary China and the process of the development of the rule of law, this paper expounds that the ideological and political work consciousness and the improvement of ideological and cultural quality of the personnel involved in the mediation must be protected from the mechanism in order to bring into play the ideological and political work in pretrial mediation. Only by the joint action of all aspects can the ideological and political work in pretrial mediation be carried out in an orderly manner, disputes can be resolved in time and effectively, and the society be more harmonious.
