当前我国法官职业道德教育问题研究

【摘要】：伴随着我国法治社会建设的逐步深化，法律体系的日臻完善，人民法院在法治社会建设进程的作用也将越来越重要。法官是重要的司法者,职业道德是法官应具备的基本素质。加强法官职业道德教育至关重要，不仅有助于提升法官的道德素质，而且也有助于维护司法公正，弘扬社会正气。本文选取法官职业道德教育作为研究对象，运用法学、伦理学、教育学等综合研究方法，对法官职业道德教育的理论与实践进行了阐述与分析。文章在具体阐述相关理论的基础上，又具体从社会环境、内在机制、职业道德教育、自主学习等角度探讨在当前形势下如何进行法官职业道德教育，尝试性地提出了法官在当代社会中加强职业道德教育的基本途径。本文主体共分为三部分：首先，阐释法官职业道德教育的相关基本理论，明确法官职业道德教育与一般社会道德教育的区别与联系。在此基础上，对法官职业道德教育的特点进行归纳与提揭。我们认为，教育标准较之社会公德有更高要求，法官职业道德教育有着比社会公德教育更为严格的教育标准，更强调其他律与自律的作用。法官职业道德教育内容较之普通道德教育更有针对性。最高人民法院颁布的《中华人民共和国法官职业道德基本准则》与中共中央颁布的《公民道德建设实施纲要》对比来看，体现出国家对法官更高、更严格的职业道德要求。在教育途径上，较之普通道德教育更注重司法实践活动。法官职业道德教育虽然与家庭、学校教育都有直接的关系，但社会教育和司法实践中的教育显然更重要，更直接。这也是与普通德育教学的区别所在。通过比较分析，我们更容易找出法官职业道德教育自身的特点。其次，阐述当前法官职业道德教育存在的问题及成因。改革开放后，国家司法机构为提高法官的职业道德，积极探索不断努力，取得了显著的效果，法官职业道德教育模式逐渐完善。但是，由于受主客观方面的影响，我国法官职业道德教育实际上在理论和实践上都相对薄弱，还存在诸多问题。诸如职业道德教育机制不完善、主体道德责任意识淡漠、职业道德教育内容与方法滞后，尤其是职业道德考评制度和监督机制缺失等问题，在法官职业道德教育中普遍存在。上述诸多问题的产生，既有深刻的历史根源，又有现实因素。综合考察认为，既有多元文化与多元价值观的影响，也有法官队伍职业道德素质有待提高和法官职业化尚需成熟等一些因素。研究影响法官职业道德教育的因素，目的是进一步提高法官职业道德教育质量与效果，提高法官队伍整体素质，维护司法公正与社会正义。最后，构建全方位的法官职业道德教育体系。法官的职业道德教育体系，就外部而言是和整个社会环境相互联系，相互制约的；就其体系内部而言，法官职业道德教育既有一般职业道德教育的共性又有自身的特殊性。在法官职业道德教育过程中，法官职业道德修养的提高依赖于外围环境和内部机制的完善及相应教育和学习方面等重要渠道。加强我国法官职业道德教育体系建设，，必须制定出切实有效的办法，同时重在落实，而非流于形式，只有这样才能真正起到整肃法官队伍、提升其道德水平的作用。
[Abstract]:With the gradual deepening of the construction of the rule of law society and the perfection of the legal system , the role of the people ' s court in the construction process of the rule of law society will be more and more important . The judge is an important judicial person , and the professional ethics is the basic quality that the judge should possess .

The main body is divided into three parts :

Firstly , the basic theory of professional ethics education of judges is explained , and the differences and connections between professional ethics education and general social moral education are clarified . On the basis of this , the characteristics of professional ethics education of judges are summed up .

After the reform and opening - up , the national judicial institutions have been relatively weak in theory and practice , and there are many problems in the professional ethics education of judges .

Finally , we construct an omni - directional professional ethics education system . The professional ethics education system of judges is interrelated and mutually restricted to the outside and the whole social environment .
In the process of professional ethics education of judges , the improvement of professional ethics of judges depends on the perfection of peripheral environment and internal mechanism and the corresponding education and learning .
