司法改革视野中的审判管理制度完善

【摘要】:随着经济社会的发展,利益格局的调整,各种深层次的社会矛盾和社会问题日渐显露,各种矛盾纠纷越来越多地以案件的形式进入司法渠道,世情、国情、民情、社情的不断变化,给人民法院工作带来了前所未有的挑战。一方面社会矛盾突显,法治进程加快,诉讼案件大幅增长,人民群众的司法需求逐日提高;另一方面案多人少,法官素质参差不齐,面对日益繁重的审判执行工作和难度不断增加的司法诉求,人民法院司法能力与人民群众日益提高的司法需求之间的矛盾亦发凸显。面对日新月异的变化,人民法院必须加快司法改革的步伐,改革不适应当今社会发展的体制、机制建设。审判管理制度这一司法改革进程中的新兴事务应运而生。1999年,人民法院“一五”改革纲要提出要“建立科学的案件审理流程管理制度”,由此拉开了审判管理的帷幕。2004年,“二五”改革纲要将改革和完善司法审判管理制度作为一项重要任务提出来,并将审判管理工作和审判的职能区分开来,把审判管理制度与法院其他管理制度的界限作了明确划分。2009年,“三五”改革纲要又进一步提出,要改革和完善审判管理制度。健全权责明确、相互配合、高效运转的审判管理工作机制。经过十几年的不断探索,先后形成了审判流程管理模式、事务性管理模式、权力管理模式、质量监督模式、综合管理模式等不同的审判管理模式。现阶段,我国法院审判管理仍处于不断探索、总结、完善的阶段,从全国情况来看,没有统一的审判管理模式。不可不论,审判管理工作还存在许多问题和不足之处,审判管理工作开展得不够平衡、理念不先进、定位不明确、方式方法不科学、制度机制不健全、精细化程度不够等问题制约着审判管理的科学发展。审判管理从操作层面来说是一门艺术。实现审判管理的目的,正确的理念、健全的制度、科学的审判管理方法都不容忽视。基于此,作者萌发了写作此文的念头,准备从一个基层法律工作践行者的角度,对审判管理的概念、发展历程、目标和价值追求、现行模式进行阐述,以便大家对审判管理有准确的认识,在此基础上指出审判管理存在的问题,结合自己的工作,对审判管理工作的进行了初步完善,为审判管理工作的改革提供微薄之力,使之成为推进人民法院司法改革的内生力量。
[Abstract]:With the development of economy and society and the adjustment of interest pattern, various kinds of deep-seated social contradictions and social problems are gradually revealed. More and more contradictions and disputes enter the judicial channels in the form of cases. The constant change of the social situation has brought unprecedented challenges to the work of the people's court. On the one hand, social contradictions highlight the acceleration of the process of the rule of law, the substantial increase in litigation cases, and the increasing judicial needs of the masses of the people.On the other hand, the number of cases is large and the number of cases is small, and the quality of judges is uneven. In the face of the increasingly onerous trial execution and the increasing difficulty of the judicial appeal, the contradiction between the judicial capacity of the people's court and the increasing judicial demand of the people is also highlighted. In the face of the rapid changes, the people's court must speed up the pace of judicial reform, the reform does not adapt to the current social development of the system, mechanism construction. The trial management system, a new affair in the process of judicial reform, came into being. In 1999, the reform outline of the people's court in the "first five year Plan" proposed to "establish a scientific trial process management system", which opened the curtain of trial management. The reform outline of the second Five-Year Plan puts forward the reform and improvement of the judicial trial management system as an important task, and distinguishes between the work of trial management and the functions of trial. In 2009, the "third five" reform outline further put forward that the trial management system should be reformed and perfected. Improve the power and responsibility of clear, mutual coordination, efficient operation of the trial management mechanism. After more than ten years of continuous exploration, the trial process management mode, the transactional management mode, the power management mode, the quality supervision model, the comprehensive management model and so on have been formed successively. At present, the court trial management in our country is still in the stage of continuous exploration, summary and perfection, and there is no unified trial management mode from the point of view of the national situation. No matter what, there are still many problems and deficiencies in the administration of trial, the work of trial management is not balanced, the concept is not advanced, the orientation is not clear, the methods and methods are not scientific, the system mechanism is not perfect, The scientific development of trial management is restricted by some problems, such as the degree of refinement. Trial management is an art in terms of operation. Realizing the aim of trial management, correct idea, perfect system and scientific trial management method can not be ignored. Based on this, the author germinated the idea of writing this article, and prepared to expound the concept, development course, goal and value pursuit, current mode of trial management from the angle of a grass-roots legal practitioner. So that everyone can have an accurate understanding of trial management, and on this basis point out the problems existing in trial management, combine with their own work, and make preliminary improvements to the trial management work, and provide a modest contribution to the reform of trial management work. Make it become the endogenous force that promotes the judicial reform of the people's court.
