大调解体系下的人民调解问题研究

【摘要】：当前，我国正处于社会发展的迅猛增长期，同时社会矛盾也日益凸显化。伴随着社会经济的飞速发展及经济体制的不断变革，社会结构也在不断的变化调整中逐渐完善，同时会不断出现新的社会经济的矛盾及问题。涉及到人民群众切身利益的热点问题日益增加，人民内部矛盾问题愈演愈烈。社会的快速发展带来了不同的新的社会矛盾同时也催促了调解制度自身的进化与发展。从古至今，调解制度在我国有着源远流长的历史，中国古代就有“和为贵”的传统，在万不得已的情况下，人们都不愿意在公堂对质，而在德高望重的“老娘舅”的介入下进行谈判是双方当事人都乐意的最佳选择。在中国，调解有着深厚的群众基础和历史传统。近年来，全国各地展开了如火如荼的“大调解”运动，各地调解机构都在积极的探索适合贴近群众基层的调解格局。如何有效地对人民调解、行政调解、司法调解进行整合，，调整好调解与诉讼程序的关系、衔接，向人民群众创造建设一个公平、公正、低成本的解决利益纠纷的渠道是当下迫在眉睫的任务。伴随着2011年1月1日《人民调解法》的出台，为今后的人民调解工作的发展指明了道路，相信通过调解工作的不断发展和完善，“东方经验”必将绽放和谐的新奇葩。随着近年来大调解工作的展开，大调解工作体系基本建成。人民调解工作在大调解工作体系中占有举足轻重的地位。改革开放以来，人民调解工作发生了翻天覆地的变化，调解工作在创新中解决问题，同时也发现了许多不足和缺陷。本文主要讨论了人民调解工作在大调解工作体系下如何运作，人民调解存在的问题及解决办法，如何确立人民调解与其它调解制度的关系等问题来对大调解工作体系下的人民调解进行分析和研究。希望能对处在进化和发展中的中国特色的调解制度提供理论性的帮助。
[Abstract]:At present, our country is in the rapid growth period of social development, at the same time, social contradictions are becoming increasingly prominent. With the rapid development of social economy and the constant change of economic system, the social structure is gradually improved in the process of constant change and adjustment, and at the same time, there will be new contradictions and problems of social economy. The hot issues concerning the vital interests of the people are increasing day by day, and the contradictions among the people are becoming more and more serious. The rapid development of society has brought different new social contradictions and accelerated the evolution and development of mediation system itself. Since ancient times, the mediation system has a long history in our country. In ancient China, there was a tradition of "peace is precious." in the last resort, people are unwilling to confront each other in court. It is the best choice that both parties are willing to negotiate with the intervention of respectable uncle Niang. In China, mediation has a deep mass base and historical tradition. In recent years, the "Great Mediation" movement has been carried out all over the country. How to effectively integrate people's mediation, administrative mediation, and judicial mediation, adjust the relationship between mediation and litigation procedures, link up, and create and build a fair and just one for the masses of the people, It is an urgent task to solve interest disputes at low cost. Along with the promulgation of the people's Mediation Law on January 1, 2011, it has pointed out the way for the future development of the people's mediation work. It is believed that through the continuous development and perfection of the mediation work, "Oriental experience" will surely bloom a new wonderful flower in harmony. With the development of mediation in recent years, the system of Great Mediation has been built. People's mediation plays an important role in the great mediation system. Since the reform and opening up, the people's mediation work has undergone earth-shaking changes, mediation work in innovation to solve problems, but also found a lot of shortcomings and defects. This paper mainly discusses how the people's mediation works under the great mediation system, the problems existing in the people's mediation and the solutions to it. How to establish the relationship between people's mediation and other mediation systems to analyze and study the people's mediation under the Great Mediation system. Hope to be in the evolution and development of the Chinese characteristics of mediation system to provide theoretical help.
