浏阳市法院离婚案件的调查报告

【摘要】：离婚案件是最典型、最传统的民事案件。浏阳市法院近年审理的民事案件中,离婚案件所占比重最大,并呈逐年上升之势。通过对浏阳市法院近年审理的离婚案件的调查发现,离婚案件在起诉主体、程序运用、结案方式及实体处理结果方面呈现出很多新的特点。性格不合、长期分居、家庭暴力、一方有不良嗜好是当事人请求离婚的主要理由。市场经济体制的确立和发展,家庭功能的改变以及两性角色的模糊,个人观念的改变则是促使离婚案件呈不断上升趋势的重要因素。人民法院在审理离婚案件中存在法定标准判断难、证据少且举证困难、送达难、缺席审理离婚案件问题凸显以及案结事了的审判目标实现难等问题。进一步明确离婚的法定标准,坚持当事人取证与法院查证相结合的原则,采取多样化的送达方式,缺席审理离婚案件应慎重,在解除当事人的婚姻关系时一并处理子女和财产等问题是有效解决离婚案件审理难点的途径。
[Abstract]:Divorce cases are the most typical and traditional civil cases. Among the civil cases heard by the courts of Liuyang in recent years, divorce cases account for the largest proportion, and are rising year by year. Through the investigation of divorce cases heard by the court of Liuyang in recent years, it is found that divorce cases have many new features in the subject of prosecution, the application of procedure, the way of closing the case and the result of substantive treatment. Personality incompatibility, long separation, domestic violence and bad habits are the main reasons for divorce. The establishment and development of market economy system, the change of family function and the ambiguity of gender role, and the change of personal concept are the important factors that promote the divorce cases to be on the rise. In the trial of divorce cases, the people's court has some problems, such as difficult to judge the legal standard, less evidence and difficult to provide evidence, difficult to serve, outstanding problems in the absentee trial of divorce cases, and difficult to realize the trial goal of the case. We should further clarify the legal standards for divorce, adhere to the principle of combining the evidence collection of the parties with the verification of the court, adopt a variety of service methods, and be careful in hearing divorce cases in absentia. It is an effective way to deal with the problems of children and property in divorce cases.
