我国民事执行检察监督制度构建

【摘要】：随着法治进步,公民法律意识增强,我国的民事执行案件也逐年增多,“执行难”、“执行乱”现象成为社会各界关注重点,也成为学术界讨论的重要问题。"执行难”、”执行乱"的现象,对我国的司法形象造成较大的负面影响,不利于我国政府当下正在全力推进建设和谐社会的工作。长期以来,我国对于法院执行工作,没有专门的监督机构,采用的是法院内部管理自己工作行为的方式,由此产生了不少的问题。因此,当下我国政府应积极建立一套行之有效的法律监督体系,才能对法院的工作起到良好的监管作用。笔者认为,检察院是国家法定的专门的法律监督机关,担任这个角色,有其法定的优势。文章首先简要介绍了笔者亲身办理的一些案件,这些案件都是在检察机关检察监督下进行的,有着一定的典型意义。接着,介绍了民事执行检察监督制度;然后,对我国当下的民事执行检察监督的具体情况展开分析。在本文的最后,对怎样合理构建我国民事执行检察监督制度进行了深入的分析。
[Abstract]:With the progress of the rule of law and the strengthening of citizens' legal consciousness, the civil execution cases in our country are increasing year by year. "execution is difficult" and "execution disorder" has become the focus of attention of all walks of life in the society, and has also become an important issue discussed in academic circles. " The phenomenon of "difficult execution" and "disorder of execution" has a great negative impact on the judicial image of our country, which is not conducive to our government's efforts to promote the construction of a harmonious society at present. For a long time, our country does not have a special supervision agency for the execution of the court, but adopts the way of managing its own work behavior inside the court, which has caused a lot of problems. Therefore, our government should actively establish a set of effective legal supervision system, in order to play a good role in the work of the court. The author believes that the procuratorate is a special legal supervisory organ of the state, which has its legal advantages. The article first briefly introduces some cases handled by the author in person, which are all carried out under the supervision of procuratorial organs, and have certain typical significance. Then, it introduces the civil execution procuratorial supervision system, and then analyzes the specific situation of civil execution procuratorial supervision. At the end of this paper, the author makes a deep analysis on how to construct the procuratorial supervision system of civil execution in our country.
