司法行政事务管理与司法权的独立运行——法国模式及其批判性思考

【摘要】：以"人、财、物、案"等为主要内容的司法行政事务管理体系与司法权的运行机制有着千丝万缕的联系。司法系统的财政供给、人事安排、案件管理等决定了司法权运行的模式、样态与质量。法国的司法系统奉行"双轨制":普通司法系统实施外部主导的司法管理体系,而行政司法系统则实施内部主导的司法管理体系。两种不同模式的司法行政管理体制各有利弊,为中国时下的司法行政事务管理制度改革提供了可供比较借鉴的丰富资源。"去行政化"不等同于"去行政管理",在警惕司法行政事务管理权以各种形式直接或间接妨碍司法权独立运行的同时,我们也应借鉴法国,建立起现代的司法行政事务管理理念与制度,致力于提高司法效率与质量。
[Abstract]:The management system of judicial administration affairs, which takes "person, property, case" as its main content, is inextricably related to the running mechanism of judicial power. The financial supply, personnel arrangement and case management of judicial system determine the mode, appearance and quality of judicial power. France's judicial system follows a "two-track system": the ordinary judicial system implements an externally dominated judicial management system, while the administrative judicial system implements an internal judicial management system. The two different modes of judicial administration system have their own advantages and disadvantages, which provide rich resources for the reform of China's current judicial administration affairs management system. " "De-administration" is not equivalent to "de-administration". We should also draw lessons from France, while we are on the alert that the right to administer judicial affairs directly or indirectly hinders the independent operation of judicial power in various forms. To establish the modern concept and system of administration of judicial affairs, and to improve the efficiency and quality of the administration of justice.
