论律师的保密义务

【摘要】：律师保密义务是伴随律师职业的产生而一直在探讨的话题。随着中国经济的不断发展,法治日益完善。律师制度作为一国司法制度的重要组成部分,在法治建设中起着积极的作用。律师在享有权利的同时也负有一定的义务,而律师保密义务则事关整个律师职业的兴衰与荣辱。本文对我国现行律师保密义务的相关规定进行剖析,并指出其所存在的不足,寻求解决方案,通过法律规制与职业伦理规制对我国律师保密义务进行完善,使律师充分发挥在法治建设中所起到的作用。
[Abstract]:Lawyer's duty to keep secret is a topic that has been discussed with the emergence of lawyer's profession. With the development of Chinese economy, the rule of law is improving day by day. As an important part of a country's judicial system, the lawyer system plays an active role in the construction of the rule of law. Lawyers also have certain obligations while enjoying their rights, and the duty of confidentiality is related to the rise and fall of the profession of lawyers. In this paper, the author analyzes the relevant provisions of our country's current lawyer's obligation to keep secret, and points out its shortcomings, and seeks for a solution to perfect our country's lawyer's duty of confidentiality through legal regulation and professional ethics regulation. So that lawyers play a full role in the construction of the rule of law.
