行政权外部监督制度考察与借鉴——基于构建我国诉讼外行政检察监督制度的思考

【摘要】：正十八届四中全会通过的《中共中央关于全面推进依法治国若干重大问题的决定》提出,"检察机关在履行职责中发现行政机关违法行使职权或者不行使职权的行为,应该督促其纠正。"这一重大改革措施的提出,在行政权外部监督体系中强化了检察监督,进一步推动了检察监督跨出诉讼活动领域。笔者认为,诉讼外行政检察监督制度的构建,应当在已有探索实践的基础上,充分考察古今中外有关行政权外部监督制度的成败得失,以借鉴其有益经
[Abstract]:The "decision of the CPC Central Committee on comprehensively promoting the Rule of Law on certain Major issues", adopted by the fourth Plenary session of the 18th CPC Central Committee, states: "in carrying out their duties, procuratorial organs have found that administrative organs illegally exercise their functions and powers or do not exercise their functions and powers. They should be urged to correct. " The proposal of this important reform measure strengthens the procuratorial supervision in the external supervision system of administrative power and further promotes the procuratorial supervision to step out of the field of litigation activities. The author believes that the construction of administrative procuratorial supervision system outside litigation should be based on the existing exploration and practice, and make a full investigation of the success or failure of the external supervision system of administrative power in ancient, modern and modern countries, so as to draw lessons from it.
