合议制下审判团队改革的实践与完善

【摘要】：《司法责任制意见》的出台,进一步推动了以审判权为核心、以管理权与监督权为保障的审判权运行机制的完善以及司法责任制的落实。该意见还对"审判团队"这一新生事物作了明确规定,各地法院围绕审判团队的组建进行了积极的探索与实践。司法责任制的建立,特别是实现合议庭组成模式与审判团队的有机结合,不仅事关制度、体制的改革,更关乎思维、观念的变革。
[Abstract]:The introduction of the opinions on the Judicial responsibility system has further promoted the perfection of the operating mechanism of the judicial power and the implementation of the judicial responsibility system, with the jurisdiction as the core and the right of management and supervision as the guarantee. This opinion also makes a clear stipulation on the new thing of "trial team", and the courts in various places have carried on the active exploration and practice around the formation of the trial team. The establishment of judicial responsibility system, especially the organic combination of collegial panel formation mode and judicial team, is not only related to the reform of system and system, but also to the change of thinking and concept.
