探索人民参检员制度保障人民群众参与检察

【摘要】：正为深入贯彻落实《中共中央关于全面推进依法治国若干重大问题的决定》(以下简称《决定》)和中央关于司法改革的精神,提升人民群众对于检察工作的满意度,上海市金山区人民检察院根据最高检和市院检察改革的总体要求,以制度机制创新为核心,以办案模式转变为重点,以依法规范有序为保障,以办案质量可控为底线,以可复制、可推广为目标,探索创设人民参检员制度,即人民检察院邀请人民群众代表以表决、听证、评议等方式直接参与检察办案和其他检察工作的制度。一、创设人民参检员制度的缘起《决定》明确要求,保障人民群众参与司法;推
[Abstract]:In order to carry out in depth the decision of the CPC Central Committee on comprehensively promoting the ruling of the country according to Law (hereinafter referred to as "the decision") and the spirit of the Central Committee on judicial reform, and to enhance the people's satisfaction with procuratorial work, In accordance with the overall requirements of the Supreme Procuratorate and the procuratorial reform of the municipal court, the people's Procuratorate in Jinshan District of Shanghai takes the innovation of the system and mechanism as the core, the transformation of the handling mode as the focus, the regulation and order of the law as the guarantee, and the quality of handling the case as the bottom line. Aiming at replicating and popularizing, this paper explores the establishment of the system of people's procurators and procurators, that is, the people's procuratorate invites the representatives of the masses to participate directly in the procuratorial case handling and other procuratorial work by means of voting, hearing and evaluation. First, the origin of the founding of the system of people's procurators and procurators should be clearly defined to ensure the participation of the people in the administration of justice;
