女性服刑人员思想教育问题研究

【摘要】：随着社会主义市场经济大潮的涌动,在日新月异的社会中,女性犯罪呈现出了一些新特点:犯罪类型日益多样化,犯罪手段日益狡猾和隐蔽,犯罪人数日益增加,财产犯罪、性犯罪、暴力犯罪等日益严重,国际化趋势日益明显。目前,我国女性犯罪约占整个犯罪的10%—20%,而且在今后数年,女性犯罪率还会继续上升。那么监狱在这方面能做的贡献,只能是提高女性服刑人员教育改造质量,降低重新犯罪率。因此,如何对女性服刑人员进行思想教育,促进她们积极接受改造,提高文化水平,强化法律意识,使其早日转变成合法公民、高素质公民,就成为一个亟待解决的问题了。 虽然我国监狱对罪犯的教育改造有一整套经过实践证明了的工作体系,但对于女性服刑人员的教育改造,尤其是思想教育改造,一直是依附于对男性服刑人员教育改造理论之上的,有时并不能非常彻底地解决实际工作中遇到的问题。通过中国期刊网全文数据库对近20年的文章进行检索,与女性服刑人员思想教育有关的文章为数不多,大多是对女性罪犯心理健康问题的研究。笔者认为,广义的思想教育不仅包括为了解决罪犯思想问题所进行的教育活动,还包括罪犯心理健康教育、罪犯文化教育等方面的内容。鉴于此,本论文就在实践中如何对女性服刑人员进行思想教育改造发表一些浅见。 本论文分五部分:第一部分为引言,包括问题的提出及意义、国内外的研究现状、写作思路及结构安排、研究方法及创新之处。第二部分为罪犯思想教育概述。首先对教育的概念及产生进行概说,然后对罪犯教育改造的概念、产生与发展进行解释,进而对罪犯教育改造的实质和核心——罪犯思想教育进行概述。第三部分总结了女性服刑人员的思想特点及易出现的几种思想问题,对这几种思想进行举例、总结,找到教育的突破点,有针对性地予以教育,纠正其不良心理。然后对女性服刑人员思想教育的特点及内容进行了总结,指出对于女性服刑人员进行思想教育,要有针对女性心理和生理的特点所进行的教育,不能千篇一律,完全照搬对男性服刑人员的教育内容。第四部分对我省女子监狱思想教育工作中的两点有益经验进行举例说明。一是罪犯个别谈话教育作为对罪犯进行教育改造的一个法宝,在实践工作中发挥的巨大作用;二是对女性罪犯进行心理健康教育的重要性。第五部分指出我国女性服刑人员思想教育工作中存在的问题并提出完善建议。通过笔者自身和同事们在我省女子监狱成立近六年来的工作经验总结,提出了一些自己的看法以及在实践中切实可行的建议。 本论文从对女性罪犯进行思想教育的内容着手,通过作者自身及同事们在我省女子监狱成立六年的工作实践中总结出来的经验,对当前女性罪犯思想教育现状及几点有益建议进行了归纳总结,期望能够给理论界提供一点监狱一线女干警的工作经验,完善女性罪犯教育改造体系,提高女性服刑人员教育改造质量,最大限度地减少重新犯罪率,服务和谐社会,维护社会稳定。
[Abstract]:With the surge of the spring tide of the socialist market economy, in the changing society, the female crime has shown some new characteristics: the crime type is becoming more and more diverse, the crime means is increasingly crafty and hidden, the number of the crime is increasing, the property crime, the sexual crimes, The violent crime and so on are becoming more and more serious, and the trend of internationalization is becoming more and more obvious. Although a whole set of work system has been proved by the reform of the prison for the criminals, the reform of the education of the female prisoners, in particular the reform of the ideological education, has always been attached to the theory of the reform of the education and transformation of the male prisoners.
