我国检察文化建设现状及其完善建议

【摘要】：文化作为综合国力的重要组成部分,是一个国家和民族的精神和灵魂,是国家发展和民族振兴的强大力量,国家之间的竞争越来越表现为文化的竞争与融合、文明的碰撞与交辉。检察文化是社会主义文化的重要组成部分,是法律文化的重要分支。在我国,检察文化是检察机关及全体检察人员在履行法律监督职能和管理活动过程中逐渐形成的价值观念、思维模式、行为准则、制度规范以及相关的物质表现的总和,是社会主义先进文化的重要组成部分,是检察事业不断发展的重要力量源泉。党的十七届六中全会提出了维护社会主义文化大发展大繁荣的战略目标,在全社会致力于提升文化软实力的大背景下,加强检察文化建设是社会主义文化建设的应有之义,其重要性与必要性日益突出,加强检察文化建设,是检察机关服务党和国家工作大局,促进社会主义文化大发展大繁荣战略目标实现的必然要求,是推动检察工作和检察队伍建设科学发展的内在要求,是树立和提升检察机关形象的重要途径。近年来,全国各级检察机关在检察文化建设方面都进行了积极的实践和有益的探索,并取得了初步成效,为进一步推进检察文化建设的深入研究与广泛实践打下了坚实的基础。但同时我们也应看到,由于受到传统观念、制度设计等各方面因素的制约,我国检察文化在法治贫瘠的土壤中生长和发展起来,是社会主义中国确立现代检察制度后才真正开始的,至今还属于系统开发和全面培育阶段,在推进检察文化建设的过程中还存在不少的问题,如对检察文化的理论研究不足、对检察文化建设的重视不够、检察文化的精神内涵被忽视、检察文化建设的特色不明显、检察文化尚未形成完整的系统、检察文化地区间发展不平衡等。如此多问题的原因也是十分复杂的,既有检察文化建设还处于萌芽期,各项建设工作经验不足、资金投入不够等时间经济方面的原因,也有人们对文化传统片面的理解、区域间经济发展不平衡等传统观念和现实环境等方面的原因。针对存在的问题和原因,本文从我国检察文化建设的现状出发,从文化学和法理学的角度,开篇对文化、法律文化之间的关系进行梳理,从林林总总的文化定义中抽象出广义的文化观、中义的文化观和狭义的文化观,在分析比较的基础上从广义的文化观角度对法律文化进行界定,在此基础上,深入研究检察文化的内涵外延、结构特征、价值功能等基本问题,为检察文化建设提供理论支持。文章的第二部分对我国检察文化建设的生动实践进行概括性总结,展示我国开展检察文化建设以来取得的显著成绩,深入分析我国检察文化建设中存在的问题及存在问题的原因。文章的第三部分在分析了存在问题和原因的基础上,提出了我国检察文化建设的思路及目标,积极探讨检察文化建设的构建路径：一是提炼检察文化理念,构建检察人员共同价值体系；二是深化检察文化理论研究,为检察文化建设提供理论支持；三是坚持以人为本,充分发挥检察人员的主观能动性；四是创新文化载体和机制,为检察文化注入新的生机和活力；五是因地制宜,突出特色,树立检察文化建设的典型；六是持续推进,形成检察文化建设长效机制,实现检察文化的发展与繁荣,形成检察人员的共同的精神家园。

The procuratorial culture is an important part of the socialist culture and is an important branch of the legal culture. In our country, the procuratorial culture is the sum of the values, the mode of thinking, the code of conduct, the system standard and the related material performance that the procuratorial organs and the procurators gradually form in the course of performing the legal supervision function and the management activities, It is an important part of the socialist advanced culture, and is an important force source for the development of the procuratorial work. At the Sixth Plenary Session of the 17th CPC Central Committee of the Communist Party of China, the strategic goal of maintaining the great development of the socialist culture is put forward. In the background of the whole society's commitment to the improvement of the soft power of the culture, the strengthening of the construction of the procuratorial culture is due to the construction of the socialist culture, and its importance and necessity become more and more prominent. Strengthening the construction of the procuratorial culture is the necessary requirement of the procuratorial organ to serve the overall situation of the Party and the state and to promote the great development of the great prosperity of the socialist culture. It is the internal requirement to promote the scientific development of the procuratorial work and the procuratorial team. It is an important way to set up and improve the image of the procuratorial organs. In recent years, the procuratorial organs at all levels have carried out positive practice and beneficial exploration in the construction of the procuratorial culture, and made preliminary results, and laid a solid foundation for further research and extensive practice of the construction of the procuratorial culture. But at the same time, we should also see that, because of the restriction of the factors such as the traditional concept and the system design, our country's procuratorial culture has grown and developed in the poor soil of the rule of law, and it is the real start of the socialist China's establishment of the modern procuratorial system. In view of the existing problems and the causes, this paper, from the current situation of the construction of our country's procuratorial culture, analyzes the relationship between culture and legal culture from the angle of culture and jurisprudence, and abstracts the generalized culture from the general cultural definition of Linlin. On the basis of the analysis and comparison, the paper defines the legal culture from the view of the cultural view and the narrow sense of culture. On the basis of this, the basic question of the connotation, structure, value and function of the procuratorial culture is studied.
