河北省女子监狱企业集团制改革研究

【摘要】：监狱企业集团化改革是最近几年监狱体制改革的一个方向,为全国监狱企业的管理体制和经济发展带来了全方位、深层次的影响。在监狱和监狱企业分离的过程中,最重要的前提条件是政府对监狱监管经费的全额保障。有了对监狱的保障,监狱企业才能大刀阔斧地进行改革,那么如何建立既适应监狱发展,又适应社会主义市场经济发展的监狱企业集团公司,是全面推进监狱企业体制改革,保证监狱体制改革正确方向的一项重要课题。本文主要以现代管理学和经济学为理论基础,以集团公司的法人治理结构为研究对象,从监狱体制改革的背景入手,全面阐述了监狱企业的现状,结合现代企业制度的原则,从法人治理结构的角度,指出了监企分开后,监狱企业集团化改革的出路,其中难点问题是监狱和监狱企业集团公司的规范运行及其治理结构。通过分析国外监狱管理的经验和对国内试点情况的总结,并以河北省女子体制改革试点工作为实例,对当前监狱企业集团化改革所面临的难点问题进行了探讨,并给出了进一步深化监狱企业集团化改革的建议。首先,本文对中国监狱企业的现状进行全面的概况,并分析了监狱企业的双重属性。其次,本文比较和分析了国内外监狱企业管理体制的改革经验,探讨了监狱企业性质的定位、监企关系的处理和监狱企业集团公司的治理等问题。最后,以企业法人治理结构的理念,讨论了河北省女子监狱体制改革的实际经验,指出了改革对关键问题的处理,以及深化监狱体制集团化改革的建议。
[Abstract]:The reform of collectivization of prison enterprises is a direction of prison system reform in recent years, which has brought all-round and deep influence to the management system and economic development of national prison enterprises. In the process of separation of prison and prison enterprises, the most important prerequisite is the full guarantee of government funds for prison supervision. With the guarantee of prisons, prison enterprises can carry out drastic reforms. So, how to set up prison enterprise group companies that not only adapt to the development of prisons but also adapt to the development of the socialist market economy, is to comprehensively promote the reform of the prison enterprise system. It is an important task to ensure the reform of prison system in the right direction. Based on the theory of modern management and economics, and taking the corporate governance structure of the group company as the research object, this paper comprehensively expounds the present situation of the prison enterprise and the principles of the modern enterprise system from the background of the prison system reform. From the point of view of corporate governance structure, this paper points out the way out for the reform of prison enterprise collectivization after the separation of prison and enterprise, among which the difficult problem is the standard operation of prison and prison enterprise group company and its governance structure. By analyzing the experience of foreign prison management and summarizing the situation of domestic pilot projects, and taking the pilot work of women's system reform in Hebei Province as an example, this paper probes into the difficult problems faced by the reform of collectivization of prison enterprises at present. The suggestion of further deepening the reform of prison enterprise collectivization is also given. First of all, this paper gives a comprehensive overview of the current situation of Chinese prison enterprises, and analyzes the dual attributes of prison enterprises. Secondly, this paper compares and analyzes the reform experience of the prison enterprise management system at home and abroad, and probes into the orientation of the nature of the prison enterprise, the handling of the relationship between the prison and the enterprise and the governance of the prison enterprise group company. Finally, based on the concept of corporate governance structure, this paper discusses the practical experience of the reform of the women's prison system in Hebei Province, points out that the reform deals with the key problems, and puts forward some suggestions for deepening the reform of the prison system collectivization.
