司法过程中的法官角色分析

【摘要】：改革开放以来,随着我国社会主义市场经济的建立和发展,建立与之相适应的法制体系的要求越来越强烈,同时,越来越多的人意识到,仅仅增多法律条文并不能带来法治的实现,更重要的是进行司法改革。而在司法的变革中,法官才是这场变革的直接承受者和具体实践者,所以对法官角色的分析就显得至关重要。而且,自古以来,法官在社会生活中就扮演着十分重要的角色,他们不单是法律的执行者,更是封建伦理道德的维护者。即使时至今日,法官依然面临着扮演不同角色的问题。他们总是在法律与社会之间寻找平衡,总是在各种群体的压力之下寻求角色认同。所以,分析法官角色的多元化就成为司法改革的关键之所在。本文正是立足于对法官多元化角色分析的基础之上,通过实证研究和理论分析的方法,来诠释在司法运行过程中的法官角色问题。在本文中,笔者将先通过对中外的法官角色进行对比分析,展示中外法官角色的不同之处,为分析当前中国法官的角色提供参照。其后通过对社会转型时期下的法官角色进行分析,揭示目前导致法官角色紧张的原因,进而为讨论法官在司法运行过程中的角色扮演问题提供思考的路径。最后通过对司法过程中法官角色的扮演问题进行分析,揭示法官在审判过程中形成的化解和弥合法律与社会之间的冲突、间隙的经验,同时,法官这种对法律的非正式运作的经验,也存在可能吞噬法律的危险。因此必须要重视审判经验,谨慎对待审判经验,为继续当前的司法体制改革提供有用的参考。
[Abstract]:Since the reform and opening up, with the establishment and development of the socialist market economy in our country, the requirement of establishing a legal system corresponding to it has become more and more intense. At the same time, more and more people have realized that, Merely increasing the legal provisions will not bring the realization of the rule of law, more importantly, the judicial reform. In the judicial reform, the judge is the direct acceptor and the concrete practitioner of the reform, so the analysis of the judge's role is very important. Since ancient times, judges have played a very important role in social life. They are not only the executors of law, but also the defenders of feudal ethics. Even today, judges still face the problem of playing different roles. They always seek a balance between law and society, and role identity under pressure from various groups. Therefore, the analysis of the diversity of the role of judges becomes the key to judicial reform. This paper is based on the analysis of the diversified role of judges, through empirical research and theoretical analysis, to explain the role of judges in the course of judicial operation. In this paper, the author will first through the comparative analysis of the role of judges at home and abroad, to show the differences between the roles of judges at home and abroad, to provide a reference for the analysis of the current role of judges in China. Then through the analysis of the role of judges in the period of social transformation, it reveals the reasons that lead to the tension of the role of judges, and then provides a way to discuss the role playing of judges in the course of judicial operation. Finally, through the analysis of the role of judges in the judicial process, it reveals the experience of judges in resolving and bridging the conflict and gap between law and society, and at the same time, Judges' experience with the informal operation of law also threatens to engulf it. Therefore, we must pay attention to the trial experience, treat trial experience carefully, and provide useful reference for continuing the reform of the current judicial system.
