法官与媒体的关系研究

【摘要】：法官是社会各种互相冲突利益的中立者和公正裁判人,其作为主持社会公平正义,构筑法律信仰的一份子可以借助媒体发表个人的见解,或者以国家公务人员的身份对案件的审理作出必要的回应和解释,如此不仅有助于实现法官的个人价值,更能推动司法透明和司法公正的进程。同时,部分法官的个人素养偏低,导致对媒体正当的采访持怀疑态度并且对媒体避而远之,这不仅对法官群体的形象造成不良影响还对司法公开的有序进行增添了一定阻碍。 媒体是信息传播和宣传的平台和载体,具有开放性和传播性的特点,正因如此其所传播的信息会对公众的意识和行为产生很大的影响,它可以协助法官传播法制思想,对法官进行舆论监督以促进司法公正以及从法官群体中发掘出大量的新闻资源。与此同时,一些媒体不客观和不真实的报道也易形成媒体审判,不仅妨碍公众对案件事实的认知,还对法官的独立审判产生极其消极的影响。一些不良媒体甚至也会对法官个人进行恶意地诽谤和侮辱,损害法官的名誉以求吸引受众最大限度的关注。 法官和媒体之间本不存在冲突的关系,二者完全可以在互利共赢的基础上进行良好的互动,但是现实中的种种阻碍使二者的关系产生了微妙的变化。如何做到法官和媒体之间能够保持良好的互动,共同为构筑法律信仰和实现社会公平正义贡献各自的力量,法官和媒体都需提高自身的修养,同时,法院作为重要的权力机关对二者之间的良好互动也能起到至关重要的作用。
[Abstract]:Judges are neutrals and fair referees of all kinds of conflicting interests in society, who, as masters of social equity and justice, can express their personal opinions through the media as part of the construction of their legal beliefs. Or to give the necessary responses and explanations in the capacity of public servants, which not only helps to realize the personal value of judges, but also promotes the process of judicial transparency and justice. At the same time, some judges' personal accomplishment is on the low side, which leads to a skeptical attitude towards the proper media interview and avoids the media, which not only has a negative impact on the image of the judges group, but also increases some obstacles to the orderly conduct of judicial disclosure. The media is a platform and carrier for the dissemination and dissemination of information, which is characterized by openness and dissemination. Because of the fact that the information transmitted by the media will have a great impact on public awareness and behaviour, it can assist judges in the dissemination of legal ideas, To supervise the public opinion of judges in order to promote judicial justice and to explore a large number of news resources from the group of judges. At the same time, some media reports which are not objective and untrue are easy to form the media trial, which not only impedes the public's understanding of the facts of the case, but also has a very negative impact on the independent trial of judges. Some bad media will even vilify and insult the judge personally, and damage the judge's reputation in order to attract the maximum attention of the audience. There is no conflict between the judges and the media, and they can interact well on the basis of mutual benefit and win-win results. However, the obstacles in reality make the relationship between the two subtle changes. How to maintain good interaction between judges and the media and contribute to the construction of legal beliefs and the realization of social equity and justice, judges and the media need to improve their self-cultivation, at the same time, The court, as an important organ of power, can also play a vital role in the good interaction between the two.
