我国的司法救助制度:现状、缺陷与改革

【摘要】：我国的司法救助制度经历了较长的发展过程,目前仍存在适用范围狭窄、适用对象主要限于自然人、审批程序及撤销规定不完善、缺乏救济与监督等缺陷。为使该制度充分发挥作用,应当从提高立法层次,增加救助内容与方式,扩大救助的适用对象,增加救助的相关程序,改变救助费用的承担办法等方面进行重大改革。
[Abstract]:The system of judicial assistance in our country has experienced a long process of development. At present, there is still a narrow scope of application, the applicable object is mainly limited to natural persons, the examination and approval procedures and revocation provisions are imperfect, and the lack of relief and supervision and other shortcomings. In order to give full play to the system, major reforms should be carried out from the aspects of raising the legislative level, adding the contents and ways of aid, expanding the applicable object of aid, increasing the relevant procedures of aid, and changing the methods of bearing relief expenses.
