乡土社会型法官的社会性角色及其转型

【摘要】：法官社会性是基于社会要求、社会环境外在于法官而隐形体现的东西。从乡土社会型法官向职业法官转型是市民社会的要求,也是市民社会催生的结果。乡土社会型法官的社会性既包括风俗、习惯、人情等社会环境的影响和要求,也包括法律本身的社会性。基于乡土社会型法官社会位置的双重性,导致其社会角色本身也发生了冲突,其裁判艺术不是实用主义的,其司法风格也不是法官设计的本义。因此,基于市民社会建构的需要,应当进行理念和实践上的调整,这是一个制度性趋势。
[Abstract]:Judge sociality is based on the social requirements, the social environment lies in the judge and invisible things. The transition from the local social judge to the professional judge is the demand of the civil society and the result of the civil society. The sociality of the local social judges includes the influence and requirement of the social environment such as customs, habits, human feelings and so on, as well as the sociality of the law itself. Based on the dualism of the social position of the local social judges, their social roles themselves have been conflicted. Their adjudicative art is not pragmatic, and its judicial style is not the original meaning of the judge's design. Therefore, based on the needs of civil society construction, we should adjust the concept and practice, which is an institutional trend.
