误解与真相:舆论监督与审判独立的关系解读

【摘要】：舆论监督与审判独立,各有各的法理依据,二者并非天生的宿敌。舆论虽然可以影响法官的自由裁量,却不可能越俎代庖进行"舆论审判"。"舆论聚焦——领导过问——批示——法院遵从"的国情,才是"舆论审判"的真相。为了让舆论监督与审判独立各得其所、并行不悖,实现维护司法公正这一共同的价值目标,我们应当做到以下三点:一要宽容对待舆论监督,反对以"规范"之名行"压制"之实;二要切实保障审判独立,让法律成为法官的"唯一上司";三要大力提高法官素质,确保法律得到正确的解释和适用。
[Abstract]:Public opinion supervision and trial independence, each has its own legal basis, the two are not natural old enemies. Although public opinion can affect the discretion of judges, it is impossible to take over the "trial of public opinion". The truth of "public opinion trial" is the national condition that "the focus of public opinion-the leader asks, the instruction-the court obeys". In order to let the supervision of public opinion and the trial go hand in hand, and realize the common value goal of safeguarding judicial justice, we should do the following three points: first, we should treat the supervision of public opinion leniently and oppose the practice of "suppression" in the name of "norms"; second, we should earnestly ensure the independence of the trial and make the law the "sole superior" of the judge; and third, we should vigorously improve the quality of judges and ensure that the law is properly interpreted and applied.
