中国律师辩护词的体裁分析

　　本文运用相关语言学理论与法学知识对中国律师的辩护词进行了研究。作者在体裁分析的基础上，运用样本集合的分析方法，试图分析得出律师在辩护词中选用的体裁结构和语言策略，以及律师做出该选择的原因。 本文结合体裁分析和系统功能的相关理论，建立了自己的理论框架。首先依据Swales的“体裁”定义和Sant的“劝说理论”认定辩护词作为一种劝说性的独立体裁存在。然后，结合了Hasan的GSP理论和Swales的步骤模式得出辩护词的体裁结构。最后，对律师在辩护词中某些特定步骤下使用的词法及句法策略进行了分析。另外，在得出了辩护词在体裁结构和语言运用方面的某些特点后，本文还采用了体裁分析的交际目的标准和系统理论中语境层面的“field”，“tenor”，及“mode”概念对GSP理论进行补充，试图对律师在辩护词中体裁结构和语言策略的选择做出合理的解释。本文尝试从体裁结构的宏观层面到语言策略的微观层面对辩护词进行较为全面的分析。 作者认为体裁理论及其分析方法是提高辩护词写作教学与学习的有效途径。同时，作者也希望本文从某种程度上对法律实践中的中文语料的分析有所借鉴。
