碳排放权交易的比较法研究

【摘要】：我国已经确定将在2017年启动全国统一的碳排放权交易市场,建立完善的碳排放权交易的各项具体制度,同时制定完备的碳排放权交易法律制度为其提供法律层面的保障,使我国的碳排放权交易市场可以健康、有序运行,尽快参与到国际碳定价中,抢占有利地位,展现出中国作为负责任的大国全力执行和落实《巴黎协定》的坚定信念。然而,对于交易中涉及到的交易环节和所涉及的各项问题离不开法律制度的规范。不能忽视的事实是,我国碳排放权交易的研究较欧盟、美国等发达国家起步较晚,当然这既是劣势也是优势。一方面,我国在应对气候变化和碳排放权交易方面的相关立法不完备,在启动全国碳排放权交易市场的过程中难免要先进行相关立法的填补。另一方面,我们可以借鉴早已率先建立碳排放权交易市场并且已成熟完善的欧盟、美国等国家的经验,还要借鉴与我国同为发展中国家的印度,在建立其本国的碳排放权交易法律制度方面的特色经验,取其精华,去其糟粕,同时结合我国的基本国情,形成可以指导我国建立统一的全国性碳排放权交易市场的相关法律制度。本文重点通过对有关国际上主要国家的先进的碳排放权交易制度进行阐述,借鉴欧盟、美国和印度现有碳排放权交易法律制度的有益经验,同时总结我国各省市碳排放权交易试点成立以来的发展经验,为我国建立统一的全国性碳排放权交易市场提供法律制度方面的建议。
[Abstract]:In 2017, China has decided to launch a unified carbon trading market in China, to establish a perfect specific system of carbon emissions trading, and to establish a complete legal system for carbon emissions trading to provide legal protection. To enable China's carbon emissions trading market to operate in a healthy and orderly manner, to participate in international carbon pricing as soon as possible, to occupy a favorable position, and to demonstrate China's firm belief in the full implementation and implementation of the Paris Agreement as a responsible big country. The trading links and problems involved in the transaction cannot be ignored without the norms of the legal system. The fact that the research on carbon emissions trading in our country started later than that in the European Union, the United States, and other developed countries can not be ignored. Of course, this is both a disadvantage and an advantage. On the one hand, China's legislation on dealing with climate change and carbon emissions trading is not complete. In the process of starting up the national carbon emissions trading market, it is inevitable to fill in the relevant legislation. On the other hand, we can learn from the experience of the European Union, the United States and other countries that have already taken the lead in establishing the carbon emissions trading market and are already mature. We should also draw lessons from the experience of India, which is a developing country with China, in establishing its own legal system for carbon emissions trading, take its essence and discard its dross, and at the same time combine the basic conditions of our country. Form the relevant legal system which can guide our country to establish a unified national carbon emission trading market. This paper mainly expounds the advanced carbon trading system of the major countries in the world, and draws lessons from the European Union. The beneficial experience of the existing legal system of carbon emissions trading in the United States and India, and the development experience of carbon trading in various provinces and cities of China since the establishment of the pilot program, To establish a unified national carbon emissions trading market in China to provide legal system recommendations.
