生物制品数据保护制度剖析与战略选择

【摘要】：近年来,在美国等发达国家的推动下,生物制品数据保护日益成为国际多边或双边贸易协议中的焦点,成为药品数据保护新的发展趋势。现阶段,WTO成员国内生物制品数据保护强度呈"强—中—弱—零"梯度化分布,不同国家制度选择依赖于制度效应、本国国情、国家产业战略等因素。我国对于生物制品数据保护尚处于法律空白,研究和借鉴国外典型国家最新制度内容与选择因素,对我国未来的制度设计与选择具有重要意义。
[Abstract]:In recent years, with the promotion of the United States and other developed countries, the data protection of biological products has increasingly become the focus of international multilateral or bilateral trade agreements. It has become a new development trend of drug data protection. At present, the intensity of data protection of biological products in WTO member countries is "strong, medium, weak and zero" gradient distribution. Different countries' system choice depends on the system effect and their national conditions. Our country is still in the legal blank for the data protection of biological products. It is of great significance to study and learn from the latest system contents and selection factors of the typical foreign countries for the future system design and choice of our country.
