试述国际私法中实体问题与程序问题的划分

【摘要】：在国际私法领域,研究实体问题与程序问题的划分有着很重要的意义,其直接影响法院在审理涉外民商事案件的第一步,即将其识别为程序问题还是实体问题,从而使程序问题直接适用法院地法,而实体问题要依据准据法的指引来适用其所指向的法律。但是,至今国际上对划分标准并没有统一的认识,使得法官在审理时都是依据自己国家的利益进行划分。本文通过对国际上有关国际私法中实体问题与程序问题之划分理论的了解和评析,提出笔者对我国划分实体问题和程序问题的标准的粗浅认识,并依据这种划分的标准来讨论国际私法中实体问题与程序问题划分的相关具体问题,比如时效问题、证据问题以及赔偿问题等等,讨论这些具体问题在实践中应当被识别为程序问题还是实体问题,也就是讨论其应当适用法院地法还是依据准据法的指引来适用法律。实体问题与程序问题的划分及其涉及的具体问题的识别无论是在大陆法系国家还是普通法系国家,无论是在在国际私法的理论上还是实践上都是十分必要的,同时也是建立国际统一法体系必须考虑的一个重要问题。
[Abstract]:In the field of private international law, it is of great significance to study the division of substantive and procedural issues, which directly affects the court's first step in handling foreign civil and commercial cases, that is, whether it is a procedural issue or a substantive issue. As a result, the procedural issues are directly applicable to the law of the forum, while the substantive issues should be applied according to the guidelines of the applicable law. However, there is no unified international understanding of the standards of division. The judges are divided according to the interests of their own country. This paper analyzes the theory of the division of substantive and procedural issues in private international law. This paper puts forward the author's understanding of the criterion of dividing substantive and procedural problems in China, and discusses the specific problems related to the division of substantive and procedural issues in private international law, such as the limitation problem, according to the criterion of this division. Questions of evidence, compensation, etc., to discuss whether these specific issues should be identified in practice as procedural or substantive, That is, to discuss whether they should apply the Lex Fori or to apply the law according to the guidelines of applicable law, the division of substantive and procedural issues and the identification of the specific issues involved, whether in civil or common law countries, Both in theory and in practice, it is necessary to establish the system of international uniform law.
