水上货物运输法律制度中的诉讼时效问题研究

【摘要】:本文的研究对象是水上货物运输法律制度中的诉讼时效。本文所指的水上货物运输包括海上货物运输、国际河流货物运输以及我国沿海和内水货物运输。本文围绕《海牙规则》、《维斯比规则》、《汉堡规则》、《鹿特丹公约》和《关于内河货物运输合同的布达佩斯公约》以及我国《海商法》及相关法律法规,结合国内相关案例全面地讨论与水上货物运输有关的诉讼时效问题。 本文分六章。第一章是对整个民事诉讼时效制度的概括分析,从民法的基本原理出发,对诉讼时效的概念、诉讼时效的功能、时效的期间和起算、中止和中断以及协议延长进行详细的理论分析,为下文讨论水上货物运输诉讼时效作理论的铺垫。该章分五节,分别叙述上述五个部分的内容,与本文后五章论述的内容相对应,形成完整的结构。这样的结构设置是希望本文既有理论深度,又能结合水上货物运输法律关系的特点做实证的分析。第二至第五章讨论水上货物运输时效,分两部分,第一部分是对海上货物运输诉讼时效的讨论,第二部分是对我国沿海和内水运输诉讼时效的讨论以及对国际河流货物运输诉讼时效的讨论。第一部分包括第二至第四章,第二章讨论的是海上货物运输诉讼时效的期间和起算,由于我国并未参加任何相关的国际公约,因此有必要分国际公约和我国国内法律规定两个层面进行论述,第三章和第四章分别讨论海上货物运输诉讼时效的中止和中断及协议延长,同样也分为国际公约和我国国内法律两个层面进行论述。第五章讨论国际河流以及我国沿海和内水运输诉讼时效,分两节论述国际河流货物运输诉讼时效制度和我国沿海和内水货物运输诉讼时效制度。第六章集中分析了关于诉讼时效的三个特别问题:承运人起诉货方应适用的诉讼时效、运输合同第三方与诉讼时效的适用以及执行时效和追诉时效与诉讼时效的区别。结论部分主要总结了本文的特点并重述笔者对我国完善水上货物运输诉讼时效制度的建议。 本文论述的主要目的在于,在对国际公约和我国法律诉讼时效制度的各个要素进行详细分析和梳理的基础上,对我国水上货物运输时效制度作出有建设性的完善建议。
[Abstract]:The object of this paper is the limitation of action in the legal system of water cargo transportation.This article refers to the sea cargo transport, international river cargo transport and coastal and inland water cargo transport.This paper focuses on the Hague rules, the Visby rules, the Hamburg rules, the Rotterdam Convention and the Budapest Convention on the contract for the Carriage of goods by Inland Water, as well as the Maritime Law of China and the relevant laws and regulations.Combined with domestic related cases, this paper comprehensively discusses the limitation of action related to the carriage of goods on water.This paper is divided into six chapters.The first chapter is the general analysis of the civil limitation system, starting from the basic principles of the civil law, the concept of the statute of limitations, the function of the statute of limitations, the limitation period and the starting calculation,The theoretical analysis of suspension, interruption and extension of the agreement lays the groundwork for the following discussion on the limitation of action for the carriage of goods on water.This chapter is divided into five sections, respectively describing the contents of the above five parts, corresponding to the content discussed in the last five chapters, forming a complete structure.It is hoped that this paper can make empirical analysis on the characteristics of the legal relationship of water freight transportation.Chapters II to V discuss the limitation period for the carriage of goods on water, which is divided into two parts. The first part is a discussion of the limitation period for the carriage of goods by sea.The second part is the discussion of the statute of limitations of the coastal and internal water transportation in China and the limitation of the international river cargo transport.The first part consists of chapters II to IV, and Chapter II deals with the period and commencement of the statute of limitations for the carriage of goods by sea, since our country is not a party to any relevant international conventions,Therefore, it is necessary to discuss it from two aspects of international conventions and domestic laws. The third and fourth chapters respectively discuss the suspension and interruption of the statute of limitations in the carriage of goods by sea and the extension of the agreement.Also divides into the international convention and our country domestic law two stratification plane carries on the elaboration.The fifth chapter discusses the statute of limitations of international rivers and China's coastal and internal water transportation. It is divided into two sections to discuss the statute of limitations system of international river cargo transport and China's coastal and internal water cargo transport limitation system.Chapter six focuses on three special issues concerning the limitation of action: the limitation of action to be applied by the carrier to the cargo party, the application of the limitation to third parties and the limitation of action in the contract of carriage, and the difference between the limitation of execution and the limitation of action.The conclusion part mainly summarizes the characteristics of this paper and restates the author's suggestions on perfecting the limitation system of maritime cargo transportation in China.The main purpose of this paper is to make constructive suggestions on the prescription system of water cargo transportation on the basis of detailed analysis and combing of various elements of international conventions and the statute of limitations system of legal action in China.
