电子提单制度构建基础问题研究

【摘要】：电子提单货物信息的瞬间传递在破解纸质提单危机,解决物流的在线传送,为国际货物贸易带来巨大变革同时,电子提单载体的无形性及运行模式的改变,对现行以提单纸质介面为中心所创制的提单法律制度提出了新的挑战。电子商务化浪潮下电子提单在我国航运业的运用前景,遂使电子提单制度构建成为一项新的立法任务。本文以电子提单现有的国际立法为依据,界定了电子提单法律性质,论证了电子提单制度构建的立法原则,探索了电子提单的流通问题,提出通过创设新的法律概念"控制",作为对电子提单权利公示、转让进行法律调整的重塑概念,旨在为我国电子提单制度的构建提出一孔之见。
[Abstract]:The instant transmission of electronic bill of lading information is to solve the crisis of paper bill of lading, solve the online transmission of logistics, bring great changes to the international trade of goods, at the same time, the carrier of electronic bill of lading and the mode of operation change.This paper presents a new challenge to the current legal system of bill of lading, which is based on the paper interface of bill of lading.The prospect of the application of electronic bill of lading in China's shipping industry under the tide of electronic commerce makes the construction of electronic bill of lading a new legislative task.Based on the existing international legislation of electronic bill of lading, this paper defines the legal nature of electronic bill of lading, demonstrates the legislative principles of the construction of electronic bill of lading system, and probes into the circulation of electronic bill of lading.By creating a new legal concept "control", this paper puts forward the concept of remolding the legal adjustment of the right of electronic bill of lading to the public and transfer, in order to put forward some opinions for the construction of the system of electronic bill of lading in China.
