儿童权利保护的“非歧视”原则探究

【摘要】：作为儿童权利国际保护的一项基本原则,"非歧视"原则建立了儿童权利保护的最低限度标准,奠定了儿童权利保护的最广泛、最可能取得共识的基础。该原则在其他国际性和区域性文书中得到广泛的运用。然而,该原则在运用中存在三大问题:一是适用范围问题;二是与"平等"原则的区分问题;三是国内法衔接问题。"非歧视"原则的中国实践表现为"儿童优先",并以专门法即《未成年人保护法》的形式体现出来。"非歧视"原则的完善,需要在立法、司法中贯彻"儿童本位"观;考虑在相关儿童法律中确立儿童非歧视权;进行儿童权利教育。
[Abstract]:As a fundamental principle of the international protection of children's rights, the principle of "non-discrimination" establishes the minimum standards for the protection of children's rights and lays the foundation for the broadest and most likely consensus on the protection of children's rights. This principle is widely used in other international and regional instruments. However, there are three major problems in the application of the principle: first, the scope of application; second, the distinction between the principle of "equality" and "equality"; and third, the problem of the convergence of domestic law. " The Chinese practice of the principle of non-discrimination manifests itself in the form of "children first" and in the form of a special law, the Law on the Protection of minors. " The perfection of the principle of non-discrimination requires the implementation of the "child-centered" view in legislation and the administration of justice; the consideration of establishing the right of children to non-discrimination in relevant children's laws; and the education of children's rights.
