完善我国物流包装法律规范分析

【摘要】：物流包装就是商品流通过程中对商品发挥着保护、快捷运输、促进销售作用的过程。依照一定技术方法而采用容器、材料以及辅助材料等总体的名称。同时也是指为了达到以上目标而采用容器、材料和辅助材料的过程实施一些技术方法的操作活动。在物流流通过程中起着至关紧要的作用。在社会再次生产的过程中,处于生产的末端,流通的始端的就是物流包装。它不仅仅代表着生产的终点,同时也引领着物流环节开端。既然它是物流的始点,那么在包装完成后,经过包装的产品便具有了流通的能力,在整个物流环节中,包装一直发挥着它的保护作用,直至最后完成它的“使命”,故,包装对物流起着决定性作用。目前我国关于包装的法律规范以分散的形态分布于各个相关法律规范中。如《商标法》、《合同法》、《知识产权法》、《产品质量法》和《发不正当竞争法》;还有相关政府部门的通知、办法等;缺乏体系性。现存的一些行业标准和规范又缺乏强制力,缺乏执行力。完善物流法律规范有利于规避物流包装过程中可能过出现的风险,保障执法环节的法律依据有法可依、有据可循;及时预测风险,从而进行有利的控制和防范;同时保障了物流环节有一个良好的开端,以便接下来的各个物流环节能够顺畅进行。本文分为三个部分来论述我国物流包装法律规范体系的构建和完善。第一部分,通过对物流、物流包装、物流包装法律规范以及物流包装在物流环节中起到的作用等相关概念的界定,介绍了我国目前物流行业的发展现状以及物流包装业所处的法律环境。第二部分通过对物流包装先关法律规范的适用介绍,分析出我国目前物流包装法律规范存在的问题及原因进一步进行研究探析。本文第三部分则结合我国基本情况,针对以上对我国物流包装法律规范存在的问题及原因的探析而提出的完善对策及具体措施。希望本文能够对完善我国目前的物流包装法律规范尽些绵薄之力。
[Abstract]:Logistics packaging is a process in which commodities are protected, transported quickly, and sales are promoted in the course of commodity circulation. Containers are adopted according to certain technical methods. General names such as materials and auxiliary materials. It also refers to the use of containers in order to achieve the above objectives, The process of materials and auxiliary materials carries out some technical and methodical operations. It plays a crucial role in the process of logistics circulation. In the process of social re-production, it is at the end of production. Logistics packaging is the starting point of circulation. It not only represents the end point of production, but also leads to the beginning of logistics links. Since it is the starting point of logistics, then after packaging is completed, packaged products have the ability to circulate. In the whole logistics link, packaging has been playing its protective role until the final completion of its "mission", so packaging plays a decisive role in logistics. At present, the legal norms on packaging in China are distributed in a decentralized form among the relevant legal norms. For example, the Trademark Law, the contract Law, the intellectual property Law, the Product quality Law and the unfair Competition Law; and the notices of the relevant government departments. Methods; lack of system. Existing industry standards and norms lack of enforcement and enforcement. Perfecting the legal norms of logistics is helpful to avoid the risks that may occur in the course of logistics packaging, to ensure that the legal basis of law enforcement can be followed, to forecast the risks in time, and to carry out favorable control and prevention. At the same time, the logistics links have a good start, so that the following logistics links can proceed smoothly. This paper is divided into three parts to discuss the construction and perfection of the legal standard system of logistics packaging in China. The definition of relevant concepts such as the legal norms of logistics packaging and the role of logistics packaging in logistics links, This paper introduces the development of logistics industry in China and the legal environment of logistics packaging industry. The second part introduces the application of the legal norms of logistics packaging first. The problems and reasons of the current legal norms of logistics packaging in China are analyzed. The third part of this paper combines with the basic situation of our country. In view of the above analysis of the problems and causes of the legal norms of logistics packaging in China, the countermeasures and specific measures are put forward. I hope this paper can improve the current legal norms of logistics packaging in China to do some modest efforts.
