地方工会主导下的劳动争议调解机制探析

【摘要】:自《劳动合同法》出台以来,广大劳动者的维权意识终被唤醒。在此背景下,劳动争议案件数量以2008年为分界点经历了急剧增长,全国多个法院成立了专门的劳动争议审判庭,但目前的司法解决机制仍无法从容应对如此数量的案件。社会各方均在考虑、探索如何破解这一难题。本文着眼于进入劳动仲裁之前的调解阶段,通过完善该阶段的机制,尤其是明确该阶段牵头方,使我国的劳动争议调解机制能够形成切实高效的模式,维护劳动者权益,平衡劳动力市场,为缓解劳动争议案件的诉讼激增做出一定的贡献。本文第一章归纳了我国劳动争议解决机制和调解机制的历史变迁及目前的主要做法,通过对S市X区的实践分析了目前劳动争议调解机制中主导方所面临的困境,阻碍着调解机制的有效发挥作用。第二章对劳动争议的特点及产生原因进行分析,揭示出在这过程中正是由于工会的缺失才引发后续的争议,并对我国工会的属性进行了分析,提出在劳动争议萌芽期间工会是最适格的调解主体,指出地方工会从性质上、职能上以及使命上均能够担负起劳动争议调解阶段的主导角色。第三章基于地方工会为主导的模式下,提出对于劳动争议调解机制的有效建议。
[Abstract]:Since the introduction of the Labor contract Law, the awareness of protecting the rights of the broad masses of workers has been awakened. Under this background, the number of labor dispute cases has experienced a rapid growth with 2008 as the dividing point, and many courts throughout the country have set up specialized labor dispute courts. However, the current judicial settlement mechanism is still unable to deal with such a large number of cases. All parties in the society are considering how to solve this problem. This paper focuses on the mediation stage before entering labor arbitration, through perfecting the mechanism of this stage. In particular, to clarify the lead party in this stage, so that the labor dispute mediation mechanism of our country can form a practical and efficient model, safeguard the rights and interests of workers, and balance the labor market, In order to alleviate the proliferation of labor dispute cases, the first chapter summarizes the historical changes of labor dispute settlement mechanism and mediation mechanism in China and the current main methods. Based on the practice of X District of S City, this paper analyzes the difficulties faced by the leading parties in the present labor dispute mediation mechanism, which hinders the effective use of the mediation mechanism. The second chapter analyzes the characteristics and causes of labor dispute. This paper reveals that it is the lack of trade unions in this process that leads to subsequent disputes, and analyzes the attributes of trade unions in our country, and points out that trade unions are the most suitable subject of mediation during the embryonic period of labor disputes, and points out that local trade unions are of the nature. In the third chapter, based on the model of local trade union, the author puts forward some effective suggestions for the mediation mechanism of labor dispute.
