试论中国外派员工的相关法律问题

【摘要】:通过分析我国企业当前所面临的机遇,本文分类探讨了外派员工制度存在的一些问题。借由与类似概念的对比,笔者详细梳理了制度内部存在的法律关系,并提出完善该制度的个人意见。 第一章主要阐述中国企业外派员工的背景。社会背景主要从金融危机给我国企业“走出去”战略带来的机遇角度入手,介绍“走出去”战略对我国企业发展的重要意义;理论背景重点介绍外派员工的特殊性,例如:身份的双重性、工作的跨地域性、群体的支持性等。 第二章着力探讨外派员工制度的现状及其中存在的问题。站在法学的角度对这些问题的症结所在进行分析和研究,结合典型案例之间的对比作出归纳总结。 第三章重点从合同法、劳动法、国际法三个部门法结合的角度释明外派员工制度与其他相关制度的区别,通过实践案例的分析揭示存在于外派员工制度中的特有问题和解决方法。 第四章提出对完善我国外派员工相关法律制度的构想。在前文分析的基础上,从理论和实践两方面提出完善建议。 第五部分结语总结全文。
[Abstract]:By analyzing the opportunities faced by Chinese enterprises at present, this paper classifies and discusses some problems existing in the expatriate staff system. By comparing the reasons with similar concepts, the author makes a detailed analysis of the legal relations existing within the system. And put forward the individual opinion that consummates this system. The first chapter mainly expounds the background of Chinese enterprises' expatriate staff. The social background mainly starts with the opportunity angle that the financial crisis brings to our enterprises'"going out" strategy, and introduces the important significance of "going out" strategy to the development of our country's enterprises. The theoretical background focuses on the particularity of expatriate staff, such as dual identity, cross-regional work, group support and so on. The second chapter focuses on the status quo of expatriate staff system and the existing problems. From the point of view of law, this paper analyzes and studies the crux of these problems, and summarizes the comparison between typical cases. The third chapter focuses on explaining the differences between the expatriate staff system and other related systems from the angle of the combination of contract law, labor law and international law. Through the analysis of practical cases, it reveals the unique problems and solutions in the expatriate staff system. Chapter 4th puts forward the idea of perfecting the related legal system of expatriate staff in our country. On the basis of the previous analysis, the author puts forward some suggestions from two aspects of theory and practice. Part 5th summarizes the full text of the conclusion.
