我国与发达国家最低工资制度的比较与借鉴

【摘要】：随着经济结构变化和劳动合同法的推进,我国逐渐失去廉价劳动力的优势,如何保障一线职工工资偏低、工资增长缓慢、遭遇欠薪等社会问题成为当下迫切需要解决的难题。而目前我国规范最低工资的主要形式仅有作为部门规章《最低工资规定》,现行的《劳动法》和《劳动合同法》中最低工资制度具体相关的条文也是寥寥无几。基于此,以美国、英国及日本等发达国家的相关立法为视角,探讨其最低工资制度,对我国现行相关制度中所欠缺的诸如最低工资内涵的限定,以探讨我国最低工资保护规范应有的制度设计及应注意的相关问题。
[Abstract]:With the change of economic structure and the promotion of labor contract law, our country has gradually lost the advantage of cheap labor force. How to ensure that the wages of front-line workers are on the low side, the wage growth is slow, and the social problems such as the lack of wages become an urgent problem to be solved.At present, the main form of standardizing the minimum wage in our country is only as the regulation of the department < minimum wage regulation], and there are very few articles about the minimum wage system in the current Labor Law and the Labor contract Law.Based on this, from the perspective of the relevant legislation of the developed countries, such as the United States, Britain and Japan, this paper discusses the minimum wage system, which limits the connotation of the minimum wage, which is lacking in the current relevant system of our country.In order to explore the minimum wage protection norms due to the system design and should pay attention to the relevant issues.
