关于我国劳动合同书面化制度设置的思考

【摘要】:书面劳动合同是用人单位与劳动者确立劳动关系的协议,其中权利义务规定明确,有利于节约争议处理、劳动监督检查等成本,提高合同履行效率,所以书面劳动合同一直以来是我国劳动合同订立形式的立法目标。本文通过介绍《劳动合同法》为了强化书面形式劳动合同所做的制度安排,以及对该制度存在的原因,得出在我国当代国情的要求下,劳动合同书面化应当继续得到立法的肯定。
[Abstract]:A written labor contract is an agreement between an employer and a laborer to establish a labor relationship, in which the rights and obligations are clearly defined, which is conducive to saving the cost of handling disputes, labor supervision and inspection, and improving the efficiency of contract performance.So the written labor contract has always been the legislative target of the form of labor contract formation in our country.This paper introduces the institutional arrangements made by the Labor contract Law in order to strengthen the written form of labor contracts, and the reasons for the existence of the system, and concludes that under the requirements of the contemporary national conditions of our country,The writing of labor contract should continue to be affirmed by legislation.
