论我国生育补偿制度的构建

【摘要】:全面二孩政策的出台,给女性就业带来更多的挑战。《劳动合同法》规定企业在孕期、产期、哺乳期不得解雇女员工,《社会保险法》规定生育保险由用人单位按照国家规定参加社会统筹,女职工生育期间的医疗费和津贴由生育保险基金支付。保护性制度的相继出台,未曾减弱女性反对就业歧视的呼声。在生育制度改革的背景下,值得深入的探讨如何补偿妇女生育带来的利益损失。本文考察国内外生育制度,借鉴其他补偿制度,分析我国生育制度中存在的突出问题,试图在前人的研究基础之上,对我国生育补偿制度的构建稍作建言。全文分为三个部分:第一部分介绍生育补偿制度的基本概念。首先,通过其他补偿制度的概念定义生育补偿制度,分析其具备的特征;其次,通过与生育保险制度的对比,明晰生育补偿制度的概念;最后,与福利国家生育制度相区别加深生育补偿制度的定义。第二部分论述构建生育补偿制度的必要性和可行性。首先探讨我国目前生育制度存在的主要问题。生育行为促进公共利益,但生育是导致妇女平等就业权受损,同时企业因雇佣女工所负担的机会成本得不到补偿。其次分析构建生育补偿制度必要性和可行性的各个要素。要解决目前生育制度存在的问题,需要法律机制平衡国家、企业、妇女之间的权利义务关系;国家政策和法律的支持、企业和社会的接受程度、政府的财政能力以及国外制度的经验都是需要研究的内容。第三部分是对生育补偿制度的设计。首先对生育补偿制度进行性质定位,考虑生育补偿制度的法律载体。其次,探讨生育补偿的具体方案,主要包括政府补助、社会统筹和二者共同分担的方案。最后,论述生育补偿制度的内容,构建符合国情的生育补偿制度,制度内容主要包括补偿范围、补偿方式和补偿标准。
[Abstract]:The introduction of the comprehensive two-child policy has brought more challenges to the employment of women. The Labor contract Law stipulates that enterprises are expected to give birth during pregnancy and childbirth. Lactation period must not fire female employee, "law of social insurance" stipulates birth insurance by unit of choose and employ persons according to national regulation participate in society as a whole, the medical treatment cost and allowance of female worker birth period pay by maternity insurance fund The introduction of the protective system has not weakened the voice of women against discrimination in employment. Under the background of the reform of fertility system, it is worth discussing how to compensate for the loss of benefits caused by women's fertility. This paper investigates the fertility system at home and abroad, draws lessons from other compensation systems, and analyzes the outstanding problems existing in China's fertility system, and tries to make some suggestions on the construction of China's fertility compensation system on the basis of previous studies. The paper is divided into three parts: the first part introduces the basic concept of maternity compensation system. First, the concept of maternity compensation system is defined through the concept of other compensation systems, and its characteristics are analyzed. Secondly, the concept of maternity compensation system is clarified through the comparison with the birth insurance system. It is different from the welfare state fertility system and deepens the definition of maternity compensation system. The second part discusses the necessity and feasibility of constructing maternity compensation system. First of all, this paper discusses the main problems existing in China's current fertility system. Reproductive behavior promotes the public interest, but fertility results in women's equal right to employment, and the opportunity cost of employing women workers is not compensated. Secondly, the necessity and feasibility of constructing maternity compensation system are analyzed. In order to solve the problems existing in the current fertility system, legal mechanisms are needed to balance the rights and obligations between the State, enterprises and women; the support of national policies and laws; and the acceptance of enterprises and society. The financial ability of the government and the experience of foreign institutions are the contents that need to be studied. The third part is the design of maternity compensation system. Firstly, the nature of maternity compensation system is defined, and the legal carrier of maternity compensation system is considered. Secondly, it discusses the specific scheme of maternity compensation, mainly including government subsidy, social coordination and the scheme of sharing between the two. Finally, it discusses the content of maternity compensation system and constructs a fertility compensation system in accordance with the national conditions. The content of the system mainly includes the compensation range, compensation methods and compensation standards.
