我国劳务派遣雇主责任制度研究

【摘要】:劳务派遣雇主责任制度是一种建立在劳务派遣用工关系的基础上的关于雇主、雇员身份界定,雇主责任的分配与承担模式,以及相应保障措施的制度,是规制劳务派遣用工的重要内容。其设置既要体现劳务派遣的特殊性,也要符合本国的劳动法律传统和价值取向且要考虑劳动就业市场现状。 本文分为五个部分对我国劳务派遣雇主责任制度进行论述:第一部分,劳务派遣雇主责任概述,将雇主责任限定在劳动法领域,阐明本文所称雇主责任的关系主体是“雇主”与“雇员”,其内容上包括义务和违反义务后的责任,并论述了劳务派遣中雇主责任关系主体的认定标准。第二部分,劳务派遣雇主责任基本理论,主要介绍单一雇主责任理论与联合雇主责任理论的责任分配原则,并分析其优势与缺陷。第三部分,我国劳务派遣雇主责任制度现状分析,,阐述了我国现行劳务派遣雇主责任制度的特点是雇主身份及义务分配上的单一雇主、责任承担上的连带责任的特点,并就其设置动因进行分析,最后从模式设置和路径保障两方面分析了我国现行劳务派遣雇主责任制度的缺陷。第四部分,专门论述了《劳动合同法修正案》对现行劳务派遣雇主责任制度的影响,包括其对缺陷的弥补和不足之处。第五部分,我国劳务派遣雇主责任制度的完善,主要是在《劳动合同法修正案》的基础上对雇主责任配置模式的进一步规范提出建议,并从健全法制、发挥主体能动性和加强市场监管角度探索雇主责任的实现路径。
[Abstract]:The system of employer liability of labor dispatch is based on the relationship between labor dispatch and employment, which includes the definition of employer, the definition of employee identity, the mode of distribution and assumption of employer responsibility, and the corresponding safeguard measures. It is the important content of regulating labor dispatch. It should not only reflect the particularity of labor dispatch, but also accord with the labor law tradition and value orientation of our country and consider the present situation of labor and employment market. This paper is divided into five parts to discuss the system of employer liability of labor dispatch in our country: the first part is the summary of employer responsibility of labor dispatch, which limits employer liability to the field of labor law. This paper clarifies that the relation subject of employer's liability is "employer" and "employee", and its content includes obligation and responsibility after breach of obligation, and discusses the standard of determining the subject of employer's liability relationship in labor dispatch. In the second part, the basic theory of employer liability of labor dispatch is introduced, which mainly introduces the principle of responsibility distribution between single employer liability theory and joint employer liability theory, and analyzes its advantages and disadvantages. In the third part, the author analyzes the present situation of the employer liability system of labor dispatch in our country, and expounds the characteristics of the present employer liability system of labor dispatch in our country, which is the single employer in the identity of the employer and the distribution of obligations, and the joint and several liability in the responsibility. Finally, it analyzes the defects of the current employer liability system of labor dispatch in China from two aspects: mode setting and path guarantee. In the fourth part, it discusses the influence of the Amendment of Labor contract Law on the liability system of labor dispatch employers, including its remedy for defects and deficiencies. The fifth part, the perfection of employer liability system of labor dispatch in our country, mainly puts forward suggestions to further standardize the mode of employer's responsibility allocation on the basis of "Labor contract Law Amendment", and improves the legal system. To explore the realization path of employer's responsibility from the angle of giving play to the main body's initiative and strengthening the market supervision.
