SHCE集团劳务派遣用工转商务用工的管理案例研究

【摘要】:进入21世纪,我国加入WTO,标志着对外开放的门户实质性打开了,经济得以迅速发展,从而加快了国有企业体制改革和运营模式的战略调整,人力资源结构与流动也全面国际化,社会结构与企业机制向工业化、城镇化、全球化快速调整,形成了企业自主用工、劳动者自主择业和以劳动力为资源的第三方派遣为驱动的人力资源大环境,依靠人力资源运作的人事代理、人力资源外包、劳务派遣等公司如雨后春笋般蓬勃发展起来,使得还未来得及规范的劳动力市场呈现用工多元化发展。在此背景下,2008年《中华人民共和国劳动合同法》全面实施,但是企业为了达到用工的灵活性,规避用工的法律成本,纷纷把员工的劳动关系转移至劳务派遣公司,使企业与劳动者不再完全是甲方和乙方的关系,而是甲方和丙方、甚至丁方的关系,乙方则成为灵活用工和廉价劳动力的载体,劳务派遣行业因为《劳动合同法》的实施而蓬勃发展起来。 许多企业为了节省人力成本,纷纷效仿,大量引入了劳务派遣机制,以致企业对劳务派遣的需求数量快速庞大,呈现“滥用”和岗位由临时性、辅助性向长期性、关键性岗位渗透,逐步“高端化”。随着2013年7月劳动合同法修正案的实施和政府调控力度强化,劳动者工资性收入和福利性收入水平逐年上升,企业利用劳务派遣的成本优势逐步消失,而面对激烈的市场竞争,各大企业欲在短期内降低竞争成本,不约而同的把目光再次转向本企业人力资本结构的调整上。 本文在撰写过程中,基于以上因素注重可操作性和实用性,以SHCE集团的劳务派遣工和所签约的各劳务派遣公司状况为调研方向,分析并提出如何通过转变生产运营模式来推进企业劳务派遣向BPO(商务外包)用工转型的方法,利用外部优秀的专业化团队来承接商务活动,使企业通过人力资源管理模式的调整,达到降低成本、提高效率、增强企业核心竞争力和对环境的应变能力,实现人员总量控制,为企业提供规避派遣用工的风险。
[Abstract]:Entering the 21st century, China's entry into the WTO indicates that the door to the outside world has opened substantially and the economy has developed rapidly, thus speeding up the reform of the state-owned enterprise system and the strategic adjustment of the operation mode, and the overall internationalization of the structure and flow of human resources. The rapid adjustment of social structure and enterprise mechanism towards industrialization, urbanization and globalization has formed a large environment of human resources driven by the independent employment of enterprises, the choice of jobs by workers and the third party dispatch of labor resources. Relying on human resource operation of personnel agents, human resources outsourcing, labor dispatch and other companies have sprung up, making the labor market has not yet been standardized to present a diversified development of employment. In this context, the Labor contract Law of the people's Republic of China was fully implemented in 2008, but in order to achieve the flexibility of employment and avoid the legal cost of employment, enterprises have transferred the labor relations of employees to labor dispatch companies. So that the enterprise and laborer is no longer the relationship between Party A and Party B, but the relationship between Party A and Party C, or even Ding Fang, and Party B becomes the carrier of flexible employment and cheap labor, The labor dispatch industry has flourished because of the implementation of the Labor contract Law. In order to save manpower cost, many enterprises follow suit one after another and introduce labor dispatch mechanism in a large number. As a result, the demand for labor dispatch by enterprises is fast and huge, showing "abuse" and "temporary, auxiliary to long-term" posts. Infiltration of key posts, step by step, "high-end". With the implementation of the labor contract law amendment in July 2013 and the strengthening of government regulation and control, the wage income and welfare income level of workers are rising year by year, the cost advantage of labor dispatch is gradually disappeared, and enterprises face fierce market competition. Each big enterprise wants to reduce the competition cost in the short term, and turn its attention to the adjustment of its human capital structure again. In the process of writing, based on the above factors, we pay attention to maneuverability and practicability, and take the situation of labor dispatch workers and labor dispatch companies signed by SHCE Group as the research direction. This paper analyzes and puts forward the method of how to promote the transformation of labor dispatch to BPO (Business Outsourcing) by changing the mode of production and operation, and makes use of the excellent professional teams to undertake business activities. Through the adjustment of human resource management mode, the enterprise can reduce the cost, improve efficiency, strengthen the core competence of the enterprise and the ability to adapt to the environment, realize the total personnel control, and provide the enterprise with avoiding the risk of dispatching labor.
