商品售后服务全国联保窜货免责的法律救济

【摘要】:商品售后服务全国联保是生产者向消费者提供优质合格产品与便捷售后服务的承诺,能够降低交易成本、便利消费者售后服务的获取,有利于促进品牌间竞争,但也可能被附加不合理的交易条件用于经销渠道控制。由于存在着产品出售方和售后服务实际提供方的分离,从《合同法》《消费者权益保护法》的角度不易解决全国联保窜货免责条款争议。生产者以消费者所购产品乃跨区销售、跨区购买为由拒绝提供全国联保,是对消费者施加的不合理限制,抑制了市场竞争。基于《反不正当竞争法》与《反垄断法》有关不合理条件的不同制度设计,全国联保免责案件的诉由选择与法律适用应当有所区别。
[Abstract]:Commodity after-sales service National guarantee is a commitment by producers to provide high quality qualified products and convenient after-sales service to consumers, which can reduce transaction costs, facilitate the acquisition of after-sales service for consumers, and help promote competition among brands. But it may also be subject to unreasonable trading conditions for distribution channel control. Because of the separation between the seller of product and the actual provider of after-sales service, it is difficult to solve the dispute of the exemption clause of national protection goods from the point of view of the law of contract law and the law of protection of consumer's rights and interests. The producers refuse to provide national protection because the products purchased by consumers are trans-regional sales, which is an unreasonable restriction imposed on consumers and restrains market competition. Based on the different system design of unreasonable conditions between the Anti-unfair Competition Law and the Anti-monopoly Law, the choice of the cause of action and the application of the law in the national protection exemption cases should be different.
