浅议适用附条件的效率违约

【摘要】：效率违约作为由美国经济分析法学派提出并在美国司法实务中得到了一定认可的违约理论,在我国学界争鸣之声久已。效率违约的运用,在特定情形下确实存在促进福利增加的效用,但无条件的适用效率违约,客观上必然影响到包含在经济和道德之外的其他重要的价值。因而,对适用附条件适用的效率违约进行研究,探析订立合同主体的间所处地位实际上的不平等,分析强势主体使用效率违约和弱势主体使用效率违约的异同,思考在我国现行的合同法体系内尝试建立附条件适用的效率违约的可行性,具有重要的现实意义和一定的理论价值。
[Abstract]:As a theory of breach of contract put forward by the American School of Economic Analysis and accepted in the judicial practice of the United States, the theory of efficient breach of contract has long been debated in the academic circles of our country. The use of efficiency breach of contract does exist the utility of promoting welfare increase under certain circumstances, but the unconditional application of efficiency breach of contract objectively inevitably affects other important values which are contained in the economy and morality. Therefore, this paper studies the efficiency breach applicable to conditional application, analyzes the actual inequality between the subject of the contract, and analyzes the similarities and differences between the use efficiency breach of the strong subject and the use efficiency breach of the weak part. It is of great practical significance and theoretical value to think about the feasibility of establishing the efficiency breach of contract with conditional application in the current contract law system of our country.
