地震所引发的按揭房贷问题之研究——法律无法承受之重

【摘要】:按揭房贷是贷款、抵押和保证的联立,其成立并不引起房屋所有权移转。地震所引起的房屋毁损灭失风险应依《合同法》和最高人民法院相关司法解释解决,房屋在交付使用之前毁损灭失的,风险应由开发商承担,买受人在解除买卖合同之后,无须还贷;房屋在交付使用后毁损灭失的,风险应由买受人承担,买受人仍应依约还贷。贷款核销只是商业银行内部的一种账务处理方法,并不能消灭房贷债权。
[Abstract]:Mortgage is a combination of loan, mortgage and guarantee, and its establishment does not result in the transfer of home ownership. The risk of damage and loss caused by the earthquake shall be resolved in accordance with the contract Law and the relevant judicial interpretations of the Supreme people's Court. If the building is damaged or lost before it is put into use, the risk shall be borne by the developer, and the buyer shall, after the termination of the contract of sale and purchase, There is no need to repay the loan; if the house is damaged or lost after delivery, the risk shall be borne by the buyer, and the buyer shall still pay the loan in accordance with the contract. Loan write-off is only a kind of account handling method inside commercial bank, can not destroy the mortgage creditor's rights.
