【摘要】：新修订的《环境保护法》第25条赋予了有权部门在必要时对造成污染物排放的设施、设备实施查封、扣押的强制措施,这既是对打击环境污染行为的有力支持,也给环保部门正确实施该项措施带来挑战。结合工作实践,本文分析了实施该项措施的要件,包括实施条件、主体、裁量、文书、程序等,并从多样化培训、正确理解要件等方面提出了建议。
[Abstract]:Section 25 of the newly amended Environmental Protection Act gives the authority the authority to impose compulsory measures for the seizure and seizure of facilities and equipment that result in the discharge of pollutants, if necessary.
