【摘要】：船舶制造业是创造社会财富的支柱产业，但是又不断消耗资源，产生废弃物，造成环境污染，使得环境问题日益突出，并正在对人类的生存和发展造成严重威胁。船舶制造业发展中的污染治理问题，需要在法律上采用措施。本文分为六章，主要论述了我国船舶制造业对于环境的影响，以及国外和国内有关的法律防治的相关立法，分析了我国现今有关立法的不足，并提出了完善相关立法的具体建议。第一章绪论主要内容为本论文的选题背景和意义，分析概括了了国内外研究现状，阐述了研究思路和研究方法，并提出了本论文创新之处。第二章主要内容为阐述了现代船舶制造业的发展对于环境影响的现状，在船舶制造的过程中可能对环境产生的危害加以介绍，并且对其成因加以分析。第三章主要内容为分析国际上涉及到船舶制造业环境保护的公约，以及国外一些造船大国在船舶制造业污染防治的立法现状。第四章主要内容为介绍我国目前设计船舶制造业环境污染的立法沿革，同时分析了立法及执法方面的不足，主要是规定散乱、没有专门性立法、部门管理有交叉和空白。第五章为我国船舶制造业环境保护法律制度的完善，主要内容是完善以环境影响评价等为主要制度的立法内容，同时完善执法与加强社会监督，强化防治船舶制造业污染法律制度的行政责任、民事责任制度；通过市场准入机制、市场退出机制，，来保证船舶行业的低能耗，零污染，同时通过税收激励机制以及环保补贴机制来鼓励船企自主的进行的技术革新，防治污染。第六章为结论，是对全文内容的概括总结。
[Abstract]:Shipbuilding industry is a pillar industry to create social wealth, but it also consumes resources, produces wastes, causes environmental pollution, and makes environmental problems more and more prominent. It is a serious threat to the survival and development of human being. The problem of pollution control in the development of shipbuilding industry needs to be adopted in law. This paper is divided into six chapters, mainly discusses the impact of China's shipbuilding industry on the environment, as well as the relevant foreign and domestic legislation on legal prevention and control, and analyzes the shortcomings of relevant legislation in China. And put forward specific suggestions to improve the relevant legislation. The first chapter is the main content of the introduction of the background and significance of this paper, analysis and summary of domestic and foreign research status, elaborated the research ideas and research methods. The second chapter introduces the current situation of the development of the modern shipbuilding industry on the environmental impact and the possible harm to the environment in the process of shipbuilding. The third chapter focuses on the analysis of the international conventions concerning the environmental protection of shipbuilding industry. As well as some foreign shipbuilding countries in the shipbuilding manufacturing industry pollution prevention and control legislation status quo. 4th main content is to introduce the current design of our shipbuilding industry environmental pollution legislation evolution. At the same time, it analyzes the shortcomings of legislation and law enforcement, mainly the provisions are scattered, there is no specialized legislation, there is a cross and blank in department management. Chapter 5th is the improvement of the legal system of environmental protection in the shipbuilding industry of our country. The main content is to perfect the legislative content which takes the environmental impact assessment as the main system, at the same time to perfect the law enforcement and strengthen the social supervision, strengthen the administrative responsibility and the civil liability system of the legal system of preventing and controlling the pollution of the shipbuilding industry; Through the market access mechanism, the market exit mechanism to ensure the shipbuilding industry low energy consumption, zero pollution, at the same time through the tax incentive mechanism and environmental subsidy mechanism to encourage shipbuilding enterprises to carry out independent technological innovation.
