【摘要】：近几年“垃圾围村”现象层出不穷，农村垃圾已经成为新农村建设的障碍，生活垃圾是人们在日常生活中或者为日常生活提供服务的活动中产生的固体废弃物以及法律、行政法规规定的固体废物。随着生活水平的提高，，农村生活垃圾的产出量和材质都发生了巨大变化，同时对农村的生态环境安全构成极大威胁，且严重危害人体健康。因此对农村生活垃圾污染防治立法研究将具有重大的实践意义和理论意义。本文首先对我国农村生活垃圾污染防治的基本状况进行介绍，其次从法律体系和具体制度分析我国关于农村生活垃圾污染防治立法的现状及不足，再次通过对国内外的立法介绍，分析其对我国农村生活垃圾污染防治立法的启示，最后从立法体系的构建和具体法律制度的建立健全方面提出建立健全我国农村生活垃圾污染防治法律制度的建议。在建立健全我国农村生活垃圾污染防治立法中，本文从三方面提出完善建议。一、构建和完善农村生活垃圾污染防治法律体系，对国家层面的立法进行完善，并加强对专项立法和地方性法律法规建设；二、对我国农村生活垃圾污染防治的配套法律制度进行完善，具体包括对管理体制、垃圾分类制度的完善，确立责任延伸制度，并尝试将奖惩制度与垃圾收费制度相结合进行推行，将减量化、资源化制度运用到农村生活垃圾污染防治中去。三、加强我国农村环境保护的宣传教育机制，通过对垃圾的危害和防治危害产生的措施的宣传和不断推进农村环境保护法律知识的普及来增强公众的参与力度。
[Abstract]:In recent years, "garbage around the village" phenomenon emerged in endlessly, rural garbage has become an obstacle to the construction of new countryside. Domestic waste is the solid waste produced by people in their daily life or in the activities of providing services for daily life, as well as the solid wastes stipulated by laws and administrative regulations. With the improvement of living standards. Great changes have taken place in the output and material quality of rural domestic waste, which poses a great threat to the ecological environment security in rural areas. Therefore, it is of great practical and theoretical significance to study the legislation of pollution prevention and control of rural domestic refuse. This paper first introduces the basic situation of the prevention and control of rural domestic garbage pollution, and then analyzes the current situation and deficiencies of the legislation on the prevention and control of rural domestic garbage pollution from the legal system and the specific system. Through the introduction of domestic and foreign legislation, this paper analyzes the enlightenment of the legislation on the prevention and control of domestic garbage pollution in rural areas. Finally, from the aspects of the construction of legislative system and the establishment and perfection of specific legal system, some suggestions are put forward to establish and perfect the legal system for the prevention and control of domestic garbage pollution in rural areas. . This paper puts forward some suggestions from three aspects: first, to construct and perfect the legal system for the prevention and control of rural domestic garbage pollution, to perfect the legislation at the national level, and to strengthen the construction of special legislation and local laws and regulations; Second, improve the supporting legal system of the prevention and control of rural domestic garbage pollution, including the management system, garbage classification system, establish the responsibility extension system. And try to combine the reward and punishment system with the garbage charge system to carry out, will reduce, the resources system applies to the countryside domestic waste pollution prevention and control. Third, strengthens our country countryside environmental protection propaganda and education mechanism. The public participation is enhanced by publicizing the harm of garbage and the measures of preventing and controlling it and promoting the popularization of legal knowledge of environmental protection in rural areas.
