中国循环经济法制保障完善研究

【摘要】：以“大量消耗自然资源——大量生产——大量废弃——大量污染”为特征的传统经济发展模式,导致资源浪费、生态恶化,严重制约了社会经济的可持续发展。自1992年世界各国就可持续发展达成共识以来,诸多发达国家与地区以及某些发展中国家积极探索可持续发展的经济模式,最终提出了循环经济发展模式。循环经济作为一种能最大限度地利用资源和保护环境的经济发展模式,是解决当今世界可持续发展问题的最佳途径,也是我国经济发展到现阶段的客观要求。发展循环经济是解决我国日益严重的环境污染问题,实现经济增长方式从“粗放型”向“集约型”转变,落实科学发展观,建设资源节约型环境友好型社会,实现社会和谐的重要途径。发展经济与环境保护的矛盾并不是不可解决的,要从根本上解决它,就要实现发展方式从传统经济到循环经济的转变。循环经济的健康发展需要法律和制度作为保障,由于历史与传统片面追求经济发展等原因我国现有循环经济法制很难适应循环经济的发展,起不到保驾护航的作用,循环经济法律体系尚未建立,因此我们迫切需要建立循环经济法律体系,以促进循环经济的发展。只有从立法、执法、司法三个方面完善循环经济法制才能更好的为循环经济提供法制保障,真正实现为循环经济的发展保驾护航。循环经济法制保障的完善要置身于依法治国大环境中,既要立足于我国现实,又要吸收国外有益的经验,合理设计循环经济法制保障,实现我国循环经济的蓬勃发展。
[Abstract]:The traditional mode of economic development, characterized by "consuming natural resources in large quantities, producing in large quantities, derelicting a great deal of pollution", leads to the waste of resources and the deterioration of ecology. It has seriously restricted the sustainable development of social economy. Since 1992, the countries of the world have reached a consensus on sustainable development. Many developed countries and regions as well as some developing countries are actively exploring economic models for sustainable development. It is the best way to solve the problem of sustainable development in the world. As a mode of economic development which can maximize the use of resources and protect the environment, circular economy is the best way to solve the problem of sustainable development in the world. It is also the objective requirement of our country's economic development to the present stage. Developing circular economy is to solve the increasingly serious problem of environmental pollution in our country and realize the transformation of economic growth mode from "extensive type" to "intensive type". Implementing the scientific concept of development, building a resource-saving environment-friendly society, and achieving social harmony is an important way. The contradiction between economic development and environmental protection is not insurmountable, it should be fundamentally resolved. Must realize the development way from the traditional economy to the circular economy transformation. The healthy development of circular economy needs the protection of law and system. Due to the historical and traditional one-sided pursuit of economic development, the existing circular economy legal system in China is very difficult to adapt to the development of circular economy. The legal system of circular economy has not been established yet. Therefore, we urgently need to establish the legal system of circular economy in order to promote the development of circular economy. Only from the three aspects of legislation, law enforcement, justice to improve the circular economy legal system can better provide legal protection for circular economy. The perfection of the legal guarantee of circular economy should be placed in the environment of governing the country according to law, and should not only be based on the reality of our country, but also absorb the beneficial experience of foreign countries. Reasonable design circular economy legal guarantee, realize our country circular economy vigorous development.
