我国机动车尾气污染防治立法研究

【摘要】： 机动车,作为经济发展、现代文明进步的产物,它在带给人们方便快捷的同时,机动车尾气污染也成为大气环境质量不断恶化的首要因素。现全世界有近十亿辆机动车,机动车尾气污染排放已达到令人触目惊心的地步、已成为城市大气质量最严重的污染源。随着我国经济的高速发展,机动车保有量的不断增长,机动车尾气污染防治已到刻不容缓的地步,成为当前环境保护的突出课题。加强和完善机动车尾气污染防治立法将有效改善我国大气质量,提高城市大气质量、改善城市生活质量,推动我国环境保护事业向前发展。机动车尾气污染是指机动车排气管向大气排放各种污染物,导致大气质量受到损害,人类健康、经济和社会发展受到影响的现象。目前,由于立法缺失、职责不清、管理不到位、制度不健全等原因,我国机动车尾气污染日益严峻,对大气环境和人体健康造成了严重的危害。为了有效改变我国机动车尾气污染的现状,必须从我国的实际情况出发,借鉴国外机动车尾气污染防治立法经验,以健全和完善我国机动车尾气污染防治立法体系,逐步形成以《大气污染防治法》为核心、辅之以相关配套法律法规的合理布局,以有效遏制和治理机动车尾气污染,保护大气环境质量、保障人体健康。
[Abstract]:Motor vehicles, as the product of economic development and the progress of modern civilization, bring people convenience and speed at the same time. Motor vehicle exhaust pollution has also become the primary factor in the deterioration of atmospheric environmental quality. There are nearly 1 billion motor vehicles in the world, and the emission of vehicle exhaust pollution has reached alarming level. It has become the most serious pollution source of urban air quality. With the rapid development of our economy and the increasing number of motor vehicles, the prevention and control of vehicle exhaust pollution has reached the point of urgency. Strengthening and perfecting the legislation of motor vehicle exhaust pollution prevention and control will effectively improve the air quality of our country, improve the urban air quality, improve the quality of urban life. To push forward the cause of environmental protection in China. Vehicle exhaust pollution is a phenomenon that vehicle exhaust pipe releases a variety of pollutants into the atmosphere, resulting in damage to the quality of the atmosphere, human health, economic and social development. At present, due to the lack of legislation. Due to unclear responsibilities, inadequate management, imperfect system and other reasons, motor vehicle exhaust pollution in China is becoming increasingly serious. In order to effectively change the status quo of motor vehicle exhaust pollution in China, we must start from the actual situation of our country and learn from the foreign legislative experience of vehicle exhaust pollution prevention and control. In order to perfect and perfect the legislative system of motor vehicle exhaust pollution prevention and control in China, the law on prevention and control of air pollution has been gradually formed as the core, supplemented by a reasonable layout of relevant supporting laws and regulations. In order to effectively curb and control vehicle exhaust pollution, to protect the quality of the atmosphere environment, to protect human health.
